Statutory Remedies for UDRP Grievants

The U.S. is unusual in that grievants of a UDRP award have a statutory remedy from an adverse UDRP award, namely an action for declaratory judgement under the Anticybersquatting Consumer Protection Act (ACPA). The action is not an appeal, but a de novo assessment of the parties' rights, either that the domain name holder is cybersquatting or its registration was lawful. ICANN and the Developing World: Examining The Outreach Program

Shravanti Reddy?s recent piece draws attention to an important issue that has nagged at ICANN ever since the ill-fated at large elections, when participants from the developed world greatly outnumbered those from the developing world. This imbalance was somewhat mitigated by the regional delineation of candidates, but it nonetheless raised two important questions that have yet to be settled:

First, how can ICANN (and, more generally, Internet governance) be more inclusive of developing countries? And second (less often asked, but perhaps even more important): Why should developing countries care about ICANN -- i.e., why does the answer to the first question even matter? Spammers’ Aid Program

A couple of months ago, Microsoft Sweden launched a program called Spammers' Aid. This is a program (created and provided by Microsoft?) that is designed to help spammers reform their ways. The idea is that since spam is continually decreasing in email and spammers are finding it more and more difficult to get their mail delivered into the inbox, why not use the skills they acquired while spamming (sales and marketing, tech skills) and apply it for good? This program teaches them how. more
