Government Advisory Committee (GAC) Beijing Communiqué Inconsistent With ICANN’s gTLD Policy

The GAC Communiqué recommends that ICANN implement a range of regulations (which the GAC calls "safeguards") for all new generic top-level domains (gTLDs) covering areas ranging from malware to piracy to trademark and copyright infringement. The GAC proposes specific safeguards for regulated and professional sectors covering areas as diverse as privacy and security, consumer protection, fair lending and organic farming. “Open” or “Closed” Generic TLDs: Let the Operators Decide

(The following is an edited version of comments I submitted to ICANN regarding "closed" generic TLDs.) On February 5th, ICANN solicited comments on whether ICANN should determine the circumstances under which a generic TLD operator is permitted to adopt "open" or "closed" registration policies. Allowing gTLD operators to make these determinations, as opposed to ICANN, will promote innovation on the Internet to the benefit of consumers. more

The Introduction of New Domain Name Services: “Due Process” and Innovation

For those interested in encouraging innovation in the domain name space -- which presumably includes the ICANN community currently convening in Dakar -- the recent episode in which VeriSign proposed, and then quickly withdrew, a bundle of new services (the VeriSign anti-abuse domain use policy) raises important issues that will be revisited as new gTLDs are introduced. Some of those issues are referenced in a recent blog post by Milton Mueller, but his emphasis on "due process" suggests a regulatory framework that is not friendly to innovation. more
