On July 25th ICANN announced the publication of the Draft Report of the Independent Review of the Trademark Clearinghouse (TMCH). This study was coordinated for ICANN by the Analysis Group, in conjunction with researchers from the Center for Internet and Society at Stanford as well the University of Pennsylvania's Wharton School... while public comments on the draft report will be accepted through September 3rd, this Report was triggered by GAC concerns expressed before the Applicant Guidebook for the new gTLD program was even completed, and is not the work product of a GNSO-created working group and therefore will not directly result in the establishment of any new ICANN policy. more
As with other meetings and conferences, the IGF-USA decided to move our annual event to a virtual format held on 22-23 July. We will discuss important matters of the Internet, using the Internet from our secure Internet access points. This format allows us to continue critical dialogue safe from viruses, murder hornets and whatever else is thrown at us this year. more

Yesterday, the US Senate Committee on Commerce, Science and Transportation held hearings on ICANN's expansion of top level domains. Next week the House Energy and Commerce committee will also conduct their hearings on this same topic. more

Recently, there has been an interesting development in the liability of Internet intermediaries in Germany, and I will comment here in this text. The "Act on Copyright Liability Online Content Sharing Service Providers" began to apply on August 1, 2021 in the country. This act is a German attempt to deal with the controversy generated by the approval in 2019 of the new European directive on copyright, specifically with article 17. more

A report calling for reforms to Canada's Human Rights Commission is calling for Internet Service Providers (ISPs) to form their own monitoring body to more speedily deal with hate material hosted on their servers. The report calls for the Human Rights Act to be amended to remove provisions that have the government body censor hate speech, while at the same time calling for ISPs to invoke their terms of service to knock down hate websites. more
U.S. federal court issues preliminary injunction, holding that enforcement of Canadian order requiring Google to remove search results would run afoul of the Communications Decency Act... Canadian company Equustek prevailed in litigation in Canada against rival Datalink on claims relating to trade secret misappropriation and unfair competition. After the litigation, Equustek asked Google to remove Datalink search results worldwide. Google initially refused altogether... more
Before the American Registry for Internet Numbers' 40th Public Policy Meeting closed last week, members were reminded that the elections for two seats on its Board of Trustees was an opportunity for needed change. The opening of polls last Thursday marked the end of an era. The clue was the candidates. For the first time in ARIN’s history, at least one seat on its board would not be filled by an elected white male. more
