We need to talk about Internet responsibility, and we need to talk about it now. By "Internet responsibility," I am not referring to some abstract subjective connotation of it, but rather to an attempt to identify objective criteria that could be used as a benchmark for determining responsibility. For the past 20 something years we all have been using the Internet in different ways and for different reasons; but, have we ever contemplated what our levels of responsibility are? more
U.S. laws remain set to govern the coming multilingual internet through ICANN's new generic Top-Level Domains (gTLDs) yet the ramifications of this fact if you are Chinese, Arab, Indian, Russian or other are huge as ICANN published its 7th Applicant Guidebook in preparation for its board consideration on June 20th during the Singapore meeting. To many nations and citizens around the world, especially the non-English speaking communities, this will be seen as a strategically alarming direction for the global Internet. more
Law enforcement demands to domain name registrars were a recurring theme of the 42d ICANN public meeting, concluded last week in Dakar. The Governmental Advisory Committee (GAC) took every opportunity at its public meetings with GNSO and Board, and in its Communique to express dismay, disappointment, and demands for urgent action to "reduce the risk of criminal abuse of the domain name system." more
The National Broadband Plan that the FCC will present on 17 March will set the USA on a completely different telecoms path. This plan will hopefully show Congress that it is worthwhile making the legislative changes that will deliver the social and economic benefits of a national broadband infrastructure. more
On Wednesday 22 February the United States and The Netherlands signed a "declaration of intent" on the cooperation on fighting cybercrime. This event was reported by the press as a treaty. At least that is what all Dutch postings I read wrote, with exception of the official website of the Dutch government. So what was actually signed? Reading the news reports some thoughts struck me. more
The European Data Protection Board certainly has been keeping its records straight. Its 27 May statement starts with the following: "WP29 has been offering guidance to ICANN on how to bring WHOIS in compliance with European data protection law since 2003." All internet users have dealings with the Internet Corporation for Assigned Names and Numbers, yet the vast majority have never heard of ICANN. more
It has been over a year since I posted "The Non-Parity of the UDRP", how little did I know then compared to now! Since that posting, the corporations and their lawyers have given me a crash course in the law and I have learned much. There are many tricks that corporations will play on a domain name registrant in order to silence criticism of the corporation and to violate the registrants right of freedom of expression without frontiers. Articles, blogs, and meetings about the internet of the future are filled with happy, positive words like "global", "uniform", and "open". The future internet is described in ways that seem as if taken from a late 1960's Utopian sci-fi novel: the internet is seen as overcoming petty rivalries between countries, dissolving social rank, equalizing wealth, and bringing universal justice. If that future is to be believed, the only obstacle standing between us and an Arcadian world of peace and harmony is that the internet does not yet reach everyone... more
Australia is set to enhance its cybersecurity framework in response to recent widespread cyberattacks. The government has released its 2023 -- 2030 Cyber Security Strategy, aiming to position Australia among the top cyber-secure nations by 2030. more

Earlier this month, MarkMonitor representatives were privileged to witness, at the first ICANN meeting of 2016 in Marrakech, Morroco, the historic presentation of the plan to transfer the stewardship of key internet functions (IANA) from the United States Government to a community and consensus-based model of governance through ICANN (Internet Corporation for Assigned Names and Numbers). more
Funny how marketplace reality can poke holes in claims and theories. A debate is raging between some existing registries (Afilias, PIR, Neustar) and registrars like ourselves over the issue of 'cross-ownership' in Top-Level Domains (TLDs). At question: should the same set of shareholders be allowed to own all or part of a registry as well as a registrar that sells names in the TLD owned by the registry? These registries are saying 'no', and one of their principal objections is they think current registrars have an unfair advantage in pursuing TLD deals. more
Telco front-man Scott Cleland, in a recent blog post, thumbs his nose at the Four Internet Freedoms and says that the FCC should too. Under current leadership, it probably will. Referring to the recent submissions to the FCC by Free Press and Public Knowledge and Vuze complaining about Comcast's use of reset packets to block applications that compete with Comcast's own proprietary video entertainment offering, Cleland says "Network management trumps net neutrality." There are lots of reasons for, ahem, managing. Cleland neglects to observe that controlling congestion the way Comcast does it is like scattering nails in the road for traffic control. more
The UK's communications watchdog, Ofcom, has proposed referring Microsoft and Amazon to the Competition and Markets Authority (CMA) for further investigation into their dominance of the cloud computing market. more
