The Wall Street Journal today reported that FCC Chairman Kevin Martin wants to reject a Petition for Declaratory Ruling filed by Skype that would establish a wireless Carterfone policy, i.e., that wireless carriers must allow subscribers to use any compatible handset to access any application, content or software. Chairman Martin has confidence that the marketplace solutions obviate any necessary FCC intervention. Such optimism must derive in part from the apparently newfound willingness of one major wireless carrier, Verizon, to support aspects of open access. Perhaps Chairman Martin has confidence in the marketplace based on the magnanimous offer of most wireless carriers to pro-rate their early termination penalties by $5 a month. One of the RSS feeds that I read is Reason magazine, which is a web site for libertarians. In general, libertarians want less government intervention both in our personal lives and in the economy. The idea behind libertarians is that today's Republicans want less government intervention in our economy but are perfectly fine to have them dictate some aspects of morality. Similarly, today's Democrats want less government intervention in our personal lives but are perfectly fine with creating government bureaucracy to deliver social services. That's an oversimplified summary, but is more or less correct. Every day comes with another digital security breach, surveillance disclosure and what not. The world seems to have grown used to it and continues its business as usual. It doesn't seem to be bad enough to really act. Every day comes with new stories about the end of the Middle Class, IT taking over jobs in places where up to very recently that was inconceivable, not in people's wildest dreams would these jobs disappear. more
As my learned friend John Levine has noted, rightly, any policy that anyone has come up with thus far regarding net neutrality is based upon a Telco model. Now, think about that for a second. A telephone call costs pretty much the same if you whisper or shout. It costs the same if you make a quick phone-call or you yack for hours. These days, even long distance is trivially inexpensive, because the capacity to carry the world's phone-calls is well beyond any foreseeable demand. There is huge headroom. more
ICANN's Nominating Committee (NomCom) is both a strange animal and a precious resource. Having a committee charged with first recruiting, then selecting suitable candidates to hold key positions within ICANN is something that is often little, or even mis, understood. Within the ICANN community itself. By the very nature of its recruitment role, the NomCom has to remain secretive. About who the candidates are, at any rate. But that doesn't mean the rest of the NomCom's processes must remain so. more
So far, the debate on mass surveillance has dwelt on the immense resources made available to the agencies (NSA in the US, GCHQ in the UK), on the technological advantage that enables them to access any data and bypass encryption, and on the lack of proper oversight in those two countries. But in order to make their voices heard by their elected representatives, Internet users around the world need to have an even more complete view of the emerging reality. more

When the FCC reports on its reactions to Comcast's activities, the right response will be "You're asking the wrong question." In an interesting move the FCC's Technical Advisory Council has outlined the need for setting a 'sunset' date for the closure of the circuit switched network. This is a first step that eventually could lead to the replacement of the PSTN in the USA, rather than letting the network slowly fade into oblivion the FCC proposes the bring the issue in the open so that it can be properly evaluated and discussed. more
About 16 months ago, I heard Ed Richards of Ofcom speak at a CITI conference at Columbia, and blogged about it here.
