It's been a quarter of a century since the world's governments convened to draft up a common set of regulations about the conduct of international telecommunications. In December of 2012 the world's governments will convene to reconsider these regulations, to hopefully sign an updated set of regulations. This time around, this activity is generating considerable levels of public interest. Congressional hearings in the United States have been held, and various pronouncements of intent from various governmental, regional, and industry groups have been made. more

Why the Internet is Not Like a Railroad

When one person transmits the speech of another, we have had three legal models, which I would characterize as Magazine, Bookstore, and Railroad. The Magazine model makes the transmitting party a publisher who is entirely responsible for whatever the material says. The publisher selects and reviews all the material it published. If users contribute content such as letters to the editor, the publisher reviews them and decides which to publish. more

Proposed Changes to Australia’s Data Retention Laws Likely to Be Costly

Australians may lose their right to privacy online if the attorney-general has her way. Nicola Roxon's discussion paper is before a parliamentary inquiry. Proposals include storing the social media and other online and telecommunications data of Australians for two years, under a major overhaul of Australia's surveillance laws. The government passed a toned down version of these proposals last week, giving police the power to force telcos to store data on customers for a specific period while a warrant is sought. more

Chehadé Sends ICANN Board Farewell Letter

ICANN's current CEO Fadi Chehadé is leaving the organisation in a few weeks time. His replacement has been announced and the upcoming public meeting in Marrakech, Morrocco, will be Chehadé's final public engagement as ICANN CEO. A couple of days ago Chehadé sent the ICANN board a letter entitled "Summary of My Tenure". While the letter may have been addressed to the board, it was published on the ICANN website immediately. more

U.S. Intends to Remain in Full Control of Internet Root Zone, Says Letter from NTIA

In a letter sent by bureau of the U.S. Department of Commerce, National Telecommunications and Information Administration (NTIA) to ICANN, the department has made it clear that despite recent discussions in Paris meetings, the U.S. department intends to remain in full authority over the Internet root zone. more

Unpacking the Framework to Address DNS Abuse

As governments convene to discuss the UN Cybercrime Treaty, Google is urging caution, warning that the current draft could endanger online security and free expression.  more

Former ICANN Board Member to Congress - ICANN Needs Oversight

Karl Auerbach has written a quite long but very detailed and well thought out letter to Congress. It's not clear which members of Congress were sent the letter. Karl Auerbach is a former member of ICANN's board and is probably best remembered by many as having taken ICANN to court (and winning) in order to gain access to the organisation's financial records. more

Accountability and Redress

In ICANN circles these days, accountability is the buzz word. Nearly everybody is talking about it. Generally everybody is in favor of it, but that's where the agreement ends. This paper urges action by ICANN to provide a means for redress of grievances as an essential element of accountability. I would like to review the ICM case (the delegation of the .xxx domain), and the role of ICANN's Independent Review Panel (the IRP). As you will recall, the ICANN Board had originally awarded .xxx to ICM, but in a subsequent reconsideration had reversed the award. more

Why ICANN Doesn’t Need to Go Back to the GAC Over Dot-XXX

This Friday, it looks as though the ICANN Board will follow the clear conclusions drawn by its independent review and approve dot-xxx. Given the importance of the first use of the review process, the importance of the Board being seen to be accountable and the fact that the community was pretty unanimous in recent public comment, it is pretty much the only reasonable course of action.
