The Changing Mobile World

Today's Internet is undoubtedly the mobile Internet. Sales of all other forms of personal computers are in decline and the market focus is now squarely on tablets, "smart" phones and wearable peripherals. In 2014 these providers sold 1.5 billion such devices into the global consumer market, and doubtless 2015's numbers will be greater. This weekend Jari Arkko, Chair of the Internet Engineering Task Force (IETF), and Stephen Farrell, IETF Security Area Director, published a joint statement on the IETF blog titled: "Security and Pervasive Monitoring"... WCIT’s Security Issues

Another contentious issue at the WCIT in Dubai is 'security'. There has been a dramatic increase in nervousness regarding a whole range of security issues, especially in relation to the internet. They include: SPAM, denial-of-service-attacks, identity theft, cybercrime, cyberwarfare, and privacy issues on social media. From the list above it is clear that some of these issues are related to content, while some can be classified as national security and others as criminal offences. The Myth of 5G and Driverless Cars

A colleague sent me an article that had been published earlier this year in MachineDesign magazine that predicts that driverless cars can't be realized until we have a ubiquitous 5G network. When looking for the original article on the web I noticed numerous similar articles like this one in Forbes that have the same opinion. These articles and other similar articles predict that high-bandwidth, low-latency 5G networks are only a few years away. more

What It Takes to Prove Common Law Rights in UDRP Complaints

The Uniform Domain Name Dispute Resolution Policy now has seventeen years of history. A high percentage of disputes are indefensible and generally undefended. As the history lengthens, early registrants of dictionary word-, common phrase-, and arbitrary letter-domain names have been increasing challenged in two circumstances, namely by businesses who claim to have used the unregistered terms before respondents registered them and later by emerging businesses with no history prior to the registrations of the domain names. more

ICANN Approves At-Large Framework for Latin America

The Internet Corporation for Assigned Names and Numbers (ICANN) recently launched organizing of the individual Internet user community (At-Large) for increasing global participation and representation in ICANN. Under a framework approved by ICANN's Board of Directors, local and regional groups may now form in Latin America to involve their members in critical issues that effect their use of the Internet's domain name system. more

Satisfying the Evidentiary Demands of the UDRP

It continues to surprise that some counsel in proceedings under the Uniform Domain Dispute Resolution Policy (UDRP) are unaware or oblivious of its evidentiary demands, by which I mean they file and certify complaints with insufficient evidence either of their clients' rights or their claims. Because the UDRP requires conjunctive proof of bad faith registration and bad faith use (as opposed to the disjunctive model of the Anticybersquatting Consumer Protection Act), it should be ingrained for counsel experienced in the jurisprudence to know they cannot hope to succeed with marks postdating registration of domain names. more

Stress Test: Accountability Reconsideration Request Filed with ICANN Board

In a rapid follow-up to the unprecedented joint letter sent on August 26th by all members of the ICANN community questioning the proposed Accountability Process imposed by ICANN staff, three of the groups that signed that letter have now submitted a formal Reconsideration Request (RR) to the ICANN Board. The August 29th RR -- submitted jointly by the Business Constituency, Registry Stakeholders Group, and Non-Commercial Stakeholders group -- requests that ICANN "confer with the community as soon as possible to address these concerns and amend its plan in such a way that the community input is taken into account as the plan goes forward.  more
