WHOIS Policy at ICANN Continues to Fail

Beware of Extra Fees in UDRP Proceedings

The Uniform Domain Name Dispute Resolution Policy (UDRP) is known as an inexpensive alternative to litigation (and that's true), but some proceedings can end up costing a trademark owner more than it may have expected. There are generally two additional types of expenses that can arise during the course of a UDRP proceeding: (1) extra filing fees for certain aspects of a case filed at the Forum, and (2) an increased filing fee if the domain name registrant wants a three-member panel to decide the case. more

With .APP, ICANN’s Auction Piggy Bank Just Got Even Bigger

ICANN reports that Google paid over $25 million for .APP in the February 25 domain auction. They were willing to bid $30M, but it's a second bid auction so that was just enough to beat out whoever the second highest bidder was. The auction proceeds piggy bank just nearly doubled from $34M to about $59M dollars, and ICANN still has no idea what to do with it. more

Sanctionable Conduct for Abusing the UDRP Process

To claim a superior right to a string of characters mark owners must (first) have priority (unregistered or registered) in using the mark in commerce; and secondly, have a mark strong enough to rebut any counter argument of registrant's right or legitimate interest in the string.
