Wait and see approach on abuse attracts ICANN Stakeholder attention: A few weeks ago I made a detailed argument as to why product safety applies to domains, just like it does to cars and high chairs. Important Progress on Accountability and Transparency

The ICANN Board made a couple of important decisions regarding accountability and transparency at its 8 December meeting. Specifically, it approved compensating Directors and also enhanced ICANN's conflicts of interest rules. Technically, it was difficult and even more difficult was the consensus process to decide exactly how to do it. Proving and Rebutting Respondent Lacks Rights or Legitimate Interests in Accused Domain Names

Paragraph 4(a)(ii) of the Uniform Domain Name Dispute Resolution Policy requires complainants to offer evidence conclusive by itself or sufficient from which to infer that respondents lack rights or legitimate interests in the accused domain names. As I've pointed out in earlier essays (here and here) the standard of proof is low and relies on inference, for good reason; beyond the visual proof and what may be obtainable from on- and offline research, respondents control evidence of their choices. more

Cuba’s (Hopefully Limited) ADSL Expansion

In 2015, ETECSA announced/leaked a plan to make ADSL service available in 50% of Cuban homes by 2020. I was skeptical. Doing so would mean investing a lot of money for obsolete technology between 2015 and 2020. They have recently announced the availability of ADSL connectivity at homes in portions of seven cities and, by December, they say some home connectivity will be available in every province. more
