In its formative decades, protocols were not drafted in vacuums of bureaucratic consensus; they were forged by engineers and operators who built working code, tested it against real-world friction, and invited the global community to refine it. Today, however, the governance of core internet infrastructure often finds itself gridlocked between rigid legal boundaries and institutional inertia. As the digital ecosystem expands, a dangerous chasm has opened between technical standards and actionable policy—most notably in how we manage, protect, and securely access domain name registration data.
To bridge this chasm, a collaborative technical initiative known as Project Jake has emerged. To understand the current friction in domain registration data, one must first look at the foundational layer of internet engineering. The Internet Engineering Task Force (IETF) is the undisputed apex authority for defining communication protocols. For years, the internet relied on the legacy WHOIS protocol—a text-based, fragmented, and structurally chaotic mechanism for querying domain ownership. Recognizing this technical debt, the IETF successfully engineered and standardized its modern successor: the Registration Data Access Protocol (RDAP).
RDAP introduced structured JSON formatting, secure transport layers, and standardized query syntax. From an engineering standpoint, it was a triumph. Yet, RDAP hit a hard ceiling when deployed globally, exposing a fundamental limitation of the IETF’s mandate: protocols can dictate how data is transmitted, but they cannot dictate what data is collected or who is legally permitted to see it.
The IETF operates strictly on a “separation of mechanism from policy” doctrine. It builds the highway, but it has no jurisdiction over the vehicles, the drivers, or the traffic laws of sovereign nations. Consequently, while RDAP standardized the technical pipeline, the content flowing through that pipeline remained hopelessly fragmented. Registries and registrars operating across different continents were forced to interpret conflicting national mandates—such as the European Union’s General Data Protection Regulation (GDPR) and various domestic privacy laws—independently. The result was a patchwork of closed systems, arbitrary redactions, and broken workflows. IETF gave the world a superior technical standard, but it lacked the structural mechanism to harmonize the legal and policy frameworks required to make that standard universally functional.
If the IETF’s limitation is its strict adherence to pure protocol engineering, the challenge facing the Internet Corporation for Assigned Names and Numbers (ICANN) lies in the opposite direction: the complexities of global policy coordination.
As the overarching coordinator of the Domain Name System (DNS) root and top-level domain policies, ICANN is built upon a multi-stakeholder model designed to balance the competing interests of governments, commercial entities, civil society, and technical operators. While this model is essential for legitimate global representation, it creates a formidable structural inertia when rapid policy evolution is required.
When global privacy regulations shifted the landscape, the ICANN ecosystem spent years attempting to forge a unified, consensus-driven model for handling registration data access—such as the Temporary Specification for gTLD Registration Data and subsequent System for Standardized Access/Disclosure (SSAD) proposals. Unfortunately, these initiatives frequently bogged down in endless stakeholder negotiations, divergent cost-benefit analyses, and irreconcilable cross-border legal conflicts.
Because ICANN must appease every constituency under a consensus framework, its policy outputs often represent the lowest common denominator. For law enforcement agencies trying to trace a malicious domain in real-time, or for intellectual property holders combating sophisticated phishing rings, waiting for institutional consensus has become an operational liability. The governance machinery proved too heavy, too politicized, and too legally constrained to deliver a nimble, production-ready framework for secure data disclosure.
Recognizing that neither standard-setting bodies nor global regulatory forums could independently solve the access dilemma, Project Jake was conceived to bypass institutional gridlock through applied, collaborative engineering.
Project Jake does not seek to rewrite IETF protocols or usurp ICANN’s policy authority. Instead, it operates as an operational middleware—a secure, scalable framework built on top of existing standards like RDAP that solves the core friction points of identity, authorization, and legal compliance.
