From time to time, we see unenlightened comments about the efficacy of laws in the fight against spam. "Laws won't stop spam" being the most common. No, they won't. What laws do is dissuade some people from undertaking shoddy mailing practices or even outright spam campaigns. Laws don't stop murder, rape and robbery either, but for those un-dissuaded who undertake such heinous crimes, we, as a society, have laws for punitive effect. They pay the price society exacts for their actions. C-28 will attenuate spam in Canada, and help us to fight spam internationally. more

A Closer Look at the AIP Internet Draft Proposal

Just in time for ICANN's 44th meeting next week, a new Internet Draft has turned up, purporting to fix the centralization of the DNS. The draft has received some attention, including an article in PC World. It isn't entirely clear what the real purpose of the draft is, but it is hard to credit the notion that it is solving any technical problem. It is not much of an exaggeration to say that the Digital Millenium Copyright Act of 1998 makes the Internet as we know it possible. The DMCA created a safe harbor that protects online service providers from copyright suits so long as they follow the DMCA rules. One of the rules is that the provider has to register with the Copyright Office to designate an agent to whom copyright complaints can be sent. The 2018 IPv4 Market: Third Quarter Report

With strong performances across all market segments, the third quarter of 2018 demonstrated that there is still a voracious appetite for IPv4 numbers. At the end of the third quarter this year, the number of IPv4 transactions and volume of IP addresses traded in the ARIN market surpassed third-quarter totals for all prior years. An additional 18 million numbers were transferred in Q3, putting the total for the year at nearly 42 million numbers, a more than 160% jump compared to this same time last year. more

Net Neutrality in the US Under Fire

John McCain has introduced a new legislation at the US Senate, which is called Internet Freedom Act... I agree with the statement about the governmental control and regulation -- we've done exactly this in Bulgaria, and the results are stunning (for the US user): today Bulgaria ranks No. 1 among the EU in number of users per capita who are connected to the Internet at speeds above 100 Mbps (in the US, the typical connection speed is 3 Mpbs), or 30 times faster than the US, and in many cases, people are connected via fiber, at 1000 Mbps, or 300 times faster. more

What We Can Learn from URS Decisions (Hint: Not Much)

In addition to being rarely invoked, the Uniform Rapid Suspension System (URS), when utilized, is providing trademark owners and domain name registrants with little guidance about this domain name dispute policy. URS determinations typically offer no insight into the reasons behind an expert's decision, regardless of whether the determination was in favor of the trademark owner (to temporarily suspend the disputed domain name) or the domain name registrant (to allow the registrant to retain the domain name without interruption). more
