The basic problem posed by WSIS was the role of national governments and national sovereignty in global Internet governance. That conflict remains completely unresolved by the WSIS document. The document's thinking is still based on the fiction that there is a clear divide between "public policy" and the "day to day operation" of the Internet, and assumes that governments should be fully in control of the policy-setting function. Moreover, new organizational arrangements are being put into place which will carry on that debate for another 5 years, at least. The new Internet Governance Forum is a real victory for the civil society actors, but also fails to resolve the basic issue regarding the role of governments and sovereignty. Although called for and virtually created by civil society actors, the language authorizing its creation asks to involve all stakeholders "in their respective roles." In other words, we still don't know whether this Forum will be based on true peer-peer based interactions among governments, business and civil society, or whether it will reserve special policy making functions to governments. more
Last month, John Klensin wrote an article published here on CircleID regarding Internationalized Domain Names (IDN) Top Level Domains (TLD). Based on his Internet Draft, John suggests using language translation in the application for TLD. The advantage of this method is that all existing TLDs can now be represented in any number of languages without additional need for ICANN to create new TLD. The canonical specification of the DNS that is normally cited are the pair of quite venerable RFCs, RFC 1034, "Domain names - concepts and facilities", and RFC 1035, "Domain names - implementation and specification", both published in November 1987. However, these two specification documents are just the tip of a rather large iceberg. One compendium of all the RFCs that touch upon the DNS lists some 292 RFCs. more
An article in the September issue of Wired explores search spam and the role of .info domain names. The article, titled "Spam + Blogs = Trouble" is a good overview of the problems of search spam, blog spam, and other various forms of web activity designed to take advantage of search engines. (The article will be online September 5, but you can read it on page 104 of the print edition that is available to subscribers now). For those not versed in search spam, it's basically creating multiple websites, typically auto-generated by computers, to get good search rankings and then monetize the resulting search traffic through AdSense or affiliate programs. When you're standing close to ICANN, the domain business may seem pretty big, but when you stand farther away, not so much. Verisign's revenues are about $1 billion/year. The .COM and .NET top-level domains together have about 150M names. The next biggest gTLDS are .ORG with 25M and .INFO with 12M. The biggest new TLDs are TOP with 2.9M and .XYZ with 1.8M, with both bloated by firesale prices. The rest are smaller, mostly much smaller. more
The resale of genuine products presents particular difficulties in domain name disputes, testing the application of fair use doctrine. Several domain name disputes involving the resale of event tickets illustrate the point. I served as a panelist in one such case The Orange Bowl Committee, Inc. v. Front and Center Tickets, Inc., D2004-0947 (WIPO 2005). The decision, which issued with a dissent, explored fair use in the domain name context and addressed several related ticket resale disputes. more
It's Apple's Developers Conference time again, and in amongst the various announcements was week, in the "Platforms Status of the Union" presentation was the mention of Apples support of IPv6. Sebastien Marineau, Apple's VP of Core OS told the conference that as far as IPv4 addresses are concerned, exhaustion "is finally here", noting that this already started in 2011 in the Asia Pacific while in North America IPv4 address exhaustion is imminent. Sebastien noted that it's really important to support IPv6 in devices and applications these days... more
The U.S. Internet Revenue Service now says that criminals already had most of the information that credit bureau Equifax lost in a breach that revealed personal information about nearly 150 million people. The incident at Equifax and the IRS' mid-October admission of how much-stolen data was already in criminal hands may force changes in how the world handles personal information. more
Domainer litigation is heating up, and this lawsuit may be the most ambitious anti-domainer lawsuit to date. First, it is a putative class action lawsuit. Second, in addition to naming four leading domainer firms, the plaintiffs provocatively go after Google for providing ads to domainer sites. I believe this is the first lawsuit against Google for its domainer relationships. The complaint itself is a 121 page, 638 paragraph (with one paragraph enumerating 47 defined terms), 4.3MB behemoth alleging trademark infringement and dilution, ACPA violations, RICO and other claims. more

If you have rules and regulations but don't enforce them then there's little point in having any rules or regulations in the first place. One of the criticisms that is often leveled at ICANN is with regard to compliance issues. There are a number of areas where ICANN accredited registrars may be flounting the rules, but if nobody does anything about it then none of the registrars will have any incentive to actually comply. more
The DNS is a crucial part of today's Internet. With the fracturing of the network's address space as a byproduct of IPv4 address run down and the protracted IPv6 transition the Internet's name space is now the defining attribute of the Internet that makes it one network. However, the DNS is not a rigid and unchanging technology. It has changed considerably over the lifetime of the Internet and here I'd like to look at what's changed and what's remained the same. more

The new gTLD program will have a profound impact on the private sector's increasing dominance over Internet information resources and ownership of critical registry technical infrastructure assets. It is already anticipated that only the private sector will take full advantage of the commercial possibilities... However, the successful introduction of new gTLDs will also create new challenges of security for the private sector. more
I'm sure this is something that's been raked over before, but I don't see a common understanding of what 'Net Neutrality' actually is. Despite many of the Internetorati demanding it by law. There appear to be several different camps, which you could paint as "bottom of IP", "middle" and "top". The bottomistas would see enforced Internet Protocol itself as a premature optimisation and violation of the end-to-end principle. Unhappy that you only get IPv4 or IPv6? Still grumpy that you only have IPv4 and not even IPv6? Really miserable that your VoIP packets are staggering under the poisonous load of IPv6 headers? You're a bottomista. more
