As I predicted ICANN is pursuing its case against EPAG. They're now not only appealing the case to a higher court in Germany but are also trying to get the entire thing referred to the European Court of Justice. In an announcement late last night ICANN made it very clear what their intentions are. While they're pursuing the appeal in the higher court in the German region, which makes sense at some level, it's also very clear that they're not taking "no" for an answer. more
I was just asked the question: How many of the new Top-Level Domains (TLDs) will fail? This poor listener might have hoped for one sentence as response, but that subject is too interesting to be brief. In this scenario you can't look to historical data to measure or predict the success rate of the new TLDs because past new TLDs have been largely managed by big businesses who have strong revenue streams from other business lines that they could use to support a slacking TLD. more
In a recent press release ICANN has stated that they will publish the list of applicants for new generic Top-Level Domains (gTLDs) on April 30th. Previously many had spoken of a "big reveal" on May 1st, though that would have coincided with a public holiday in many countries and might have been "missed". However ICANN CEO, Rod Beckstrom, claims that the organisation had always planned to publish the list two weeks after the application window closed. more

I recently came across a copy of a ruling in the bizarre case of MySpace vs. theglobe.com. Theglobe.com was the ultimate dot.com bubble company. It started up here in Ithaca, and went public at the peak of dot.com hysteria with one of the the greatest one-day price runups ever. Since then they bought and sold a variety of busineses, none of which ever made any money, including the Voiceglo VoIP service which appears to be what the spam was promoting. more
As ICANN introduces new generic top level domains (gTLDs) and separates itself from US oversight, it has the opportunity to distance itself from the taint of cybersquatting, brand abuse, and criminal activity involving domains... To underscore the scope of the issue, consider this research on just 30 top Interbrand-ranked global brands. The most recent MarkMonitor Brandjacking Index found cybersquatting incidents increased over 40% in the last year for the brands that were studied; these leading brands suffered as many as 15,000 incidents per brand... more
After its first edition in Valencia, Brands and Domains will travel this time to the Netherlands where the second conference will take place from the 2nd to 3rd of October 2017. This time, Dot Stories, the main organizer, chose the Hotel Amrath Kurhaus for the event. Nowadays, more than 600 applicants hold already the right to start their own dot brand, but there are not so many who have been brave enough to use it. more
ICANN recently launched its own Twitter feed. And since ICANN is a global organization, it launched more than one language feed -- one in English and one in Spanish... This is not the most scalable solution. And I'm not trying to pick on Twitter; the issue effects any multinational company or organization. For instance, let's say ICANN launches a Portuguese feed for Brazil. The address would have to read twitter.com/icann_pt_br. Similar challenges arise with French... more
If the timeline for turn-around of clarifying questions (CQs) remains two-weeks, the long pole in your CQ tent is likely to be revising your Q50 letter of credit or escrow agreement to meet the ICANN requirements. Based upon ICANN comments, it appears that many applicants are having trouble meeting the specific letter of credit (LOC) or escrow agreement language. To remedy this ICANN should consider publishing what it considers acceptable language for an LOC or escrow agreement. more
On July 1st 2009, Rod Beckstrom succeeded Paul Twomey as the fourth CEO of the Internet Corporation for Assigned Names and Numbers (ICANN). Rod assumes this important leadership role at a critical juncture in ICANN's ongoing evolution. Saying that he is jumping into the deep end of a pool would not do justice to the magnitude of the tasks before him. The more appropriate analogy might be parachuting from a plane above the Mariana Trench during a typhoon. However, after reading some of his writings, reviewing his biography, and having met with him one-on-one during ICANN's recent Sydney meeting, I am confident that the ICANN Board made the right decision in selecting Rod to lead the organization at this defining moment in Internet governance. more

ICANN is barking up a number of wrong trees with the latest version of its Evaluation and Questions Criteria for generic top-level domains (gTLDs). The document asks for financial projections, the applicant's goals for its TLD, and the benefits the applicant expects to derive. All that information is meaningless. more
The World Intellectual Property Organization put out a release yesterday trumpeting an eight percent increase in domain name disputes handled by WIPO. In 2008 there were 2329 complaints filed with WIPO, the most ever. WIPO uses the increase to raise questions about the possible increase in the number of available generic top-level domains... more
