The Intellectual Property Constituency, meeting at the ICANN conference in Vancouver, was interested in increasing ICANN's budget not because they thought they deserved it, but because they wanted ICANN to actually enforce the rules on the books about fake registrations. Now there's some evidence about how prevalent that is. If there's any surprise here, it's that the numbers are so low. more

It is difficult to explain RFC 3743 or commonly known as the Joint Engineering Team (JET) Guidelines without some lesson on Chinese, Japanese and Korean (CJK), particularly how it relates to Internationalized Domain Names (IDN). Luckily, an Internet-Draft we wrote back in 2001 discusses the issues quite neatly in this context. In brief, Chinese characters (Hanzi) or Han ideographs are evolved from pictographs (writing made up of pictures) across thousands of years. The future of the World Summit on the Information Society (WSIS) process will be one of the main topics of the 2025 Internet Governance Forum. Many in the IG community are heavily invested in the renewal of WSIS. They imply that if it is not renewed, there will be major, negative effects on the way we govern the Internet. IGP believes that it is healthy and productive for the community to consider the possibility of ending WSIS. more

Whatever you think the answer is (typically about ten bucks), the answer is likely to change radically for the worse, based on new contracts that ICANN is planning to approve. On July 28th ICANN posted proposed new contracts for .ORG, .BIZ, and .INFO, for a public comment period that ends four days from now, on the 28th. There's a lot not to like about these proposed contracts, but I will concentrate here on two related particularly troublesome areas, pricing and data mining. more
An organization which purports to be "the voice of world business" is proposing a de facto U.N. takeover of ICANN. The proposal by a senior official of the International Chamber of Commerce (ICC) would place ICANN under the U.N. umbrella and give a strong role to U.N. agencies and to various national governments, including those that suppress free speech and free enterprise. In a move of breathtaking arrogance, the ICC refused to even invite ICANN or U.S. government representatives to the meeting at which they are presenting their proposal. more

The following is an analysis based on the hypothesis that trademark holders are not, in general, registering their trademarks as domain names across the existing top-level domain namespace. To determine if the hypothesis is true, we examine domain names registered in the popular generic top-level domains ("gTLDs" such as .com, .net and .info), also using other publicly available information such as the USPTO database of trademarks, the English dictionary, DNS entries, UDRP records and whois records. more
The new organization called Coalition for ICANN Transparency (CFIT) has filed a lawsuit against ICANN and VeriSign in order to stop implementation of the proposed .com registry agreement. According to its description, "CFIT is a not-for-profit Delaware corporation based in Washington, D.C. CFIT’s supporters include individuals, organizations, institutions and companies who are committed to the core principles on which ICANN, the internet governing body is founded." more

Although the paper is a mere 5 pages long it covers all the areas that the topic encompasses very well and is well worth a read. ICANN has consistently said its intention in complying with the European Union's General Data Protection Regulation (GDPR) is to comply while at the same time maintaining access to the WHOIS domain name registration database "to greatest extent possible." On February 28, ICANN published its proposed model. Strangely, while ICANN acknowledges that some of the critical purposes for WHOIS include consumer protection, investigation of cybercrimes, mitigation of DNS abuse, and intellectual property protection, the model ICANN proposes provides no meaningful pathway to use WHOIS in those ways. more
Wal-Mart seems to have been particularly vigilant lately about protecting itself from third parties setting up websites critiquing Wal-Mart and its practices. ...Wal-Mart recently scored a victory in an arbitration proceeding under the Uniform Domain Name Dispute Resolution Policy ("UDRP") before the World Intellectual Property Organization ("WIPO") against Jeff Milchen, a self-proclaimed critic of Wal-Mart from Bozeman, Montana who registered the domain name "walmartfacts.biz". more
On Thursday, May 20, a final decision was issued in the Independent Review Process (IRP) brought by Afilias against the Internet Corporation for Assigned Names and Numbers (ICANN), rejecting Afilias' petition to nullify the results of the July 27, 2016 public auction for the .WEB new generic top level domain (gTLD) and to award .WEB to Afilias at a substantially lower, non-competitive price. Nu Dotco, LLC (NDC) submitted the highest bid at the auction and was declared the winner, over Afilias' lower, losing bid. more
