One of the more persistent founding myths around the internet is that it was designed to be able to withstand a nuclear war, built by the US military to ensure that even after the bombs had fallen there would still be communications between surviving military bases. It isn't true, of course. The early days of the ARPANET, the research network that predated today's internet, were dominated by the desire of computer scientists to find ways to share time on expensive mainframe computers rather than visions of Armageddon. First Four Registry Agreements Signed for New TLDs

The first four new Top Level Domains (TLDs) have signed contracts with ICANN, known as Registry Agreements, to allow the applicants to operate new TLDs on the Internet. This is a historic event and marks the first of many new Registry Agreements which will be signed over the coming months as prospective new TLD operators complete the Initial Evaluation phase, pre-delegation testing, and finally sign Registry agreements. more

Short Domain Names Threatened by Proposed Policy on IGO Dispute Resolution Procedure

ICANN staff has published a draft report on dispute resolution procedures for IGO (inter-governmental organization) domain names. This proposal has deep flaws and should be rejected by the community, as it does not have the balance and protection of registrant rights present in the existing UDRP. Initially, the proposed policy would apply to new Top-Level Domains (TLDs), but via a Policy Development Process (PDP) it could be extended to existing TLDs. more

WLS Deemed Illegal by Registrar Coalition

UDRP Does Not Apply To Bad Faith Domain Name Renewals: Part I

The purpose of the Uniform Dispute Resolution Policy, known as the UDRP (hereafter the "Policy"), is to determine disputes relating to the registration or acquisition of domain names in bad faith. To succeed in a UDRP action (i.e. to obtain cancellation or transfer of the disputed domain name) it is necessary for the party bringing the complaint (the complainant) to show that (i) the disputed domain name is identical with or confusingly similar to a trademark or service mark in which the complainant has rights; (ii) the domain name holder (known as the respondent) has no right or legitimate interest in respect of the domain name; and (iii) the domain name was registered and is being used in bad faith. Each of the aforesaid three elements must be proved by the complainant to warrant relief.

Nom-Com Appoints Independent and Diverse Candidates to ICANN Leadership Positions

When 72 candidates vie for 8 positions, making tough choices are inevitable. ICANN's 2005 Nominating Committee (Nom-Com) on Friday announced the selection of a diverse and independent set of nominees for important roles in ICANN, including the Board of Directors, the Generic Names Supporting Organization (GNSO), the At-Large Advisory Council (ALAC) and the Country Code Names Supporting Organization (ccNSO). more

An Internet Security Operations Viewpoint of IGF

The Internet Governance Forum (IGF) is an annual UN conference on Internet governance which was held this year in Rio de Janeiro, Brazil. The topics discussed range from human rights online to providing Internet access in developing countries. A somewhat secondary topic of conversation is Internet security and cyber-crime mostly limited to policy and legislative efforts. Techies and Internet security industry don't have much to do there, but I have a few updates for us from the conference. more

Future of Internet Navigation and DNS: The NAS Study

The National Academy of Sciences (NAS) has been studying the issue of Internet navigation and the DNS. The study was undertaken at the request of Congress to "provide analysis and advice for consideration by agencies of the U.S. Government, interested international institutions, and other stakeholders." In addition to examining technological issues, the study is also considering "relevant legal, economic, political, and social issues...because technologies related to the DNS and Internet navigation do not operate in isolation, but must be deployed within a complex and challenging national and international context."  more

“Globally, Internet Traffic Passes Through 13 Root Servers” (!)

The Times of India recently interviewed India's Minister of State for Communications and IT, Sachin Pilot, on Internet Governance. Titled "'Internet's governance can't be limited to one geography'", the article started off with an amazing assertion by the minister... While this interview is a fairly standard restatement of the position some Governments (including India) have about governmental control of Internet Governance, it is sadly apparent that the minister unfortunately doesn't appear to understand what the root servers are, or how they work. more

To Serve the Public Interest You First Have to Define ‘Public Interest’

In the ancient parable, six blind men are asked to describe an elephant, with each coming up with wildly different answers, depending on which part of the animal they touched. Now, while I would hesitate to call participants in the ICANN process "blind men," I am starting to think that "public interest" is their elephant. ICANN is on the threshold of completing its first major obligation under the Affirmation of Commitments it signed with the U.S. Government in 2009. more
