ICANN has filed its initial response to writs of attachment issued by U.S. Courts that seek to have ICANN transfer control of the country code top level domains (ccTLDs) of Iran, Syria and North Korea to plaintiffs in various legal actions. The lawsuits were brought under a U.S. law that permits victims of terrorism and their family survivors to seek the assets of governments that provided support or direction of the terrorist acts. more
On March 27, 2014, shortly after the National Telecommunications and Information Administration's (NTIA) March 14th announcement of its intent to transfer its counterparty status on ICANN's IANA functions contract to the global multistakeholder community, the conservative advocacy organization Americans for Limited Government (ALG) filed a Freedom of Information Act (FOIA) request with NTIA. ALG's request was for disclosure of "All records relating to legal and policy analysis developed by or provided to the National Telecommunications and Information Administration (NTIA) that support its decision to "transition key internet domain name functions," including any analysis showing whether the NTIA has the legal authority to perform the transition." more
Last week, the French Senate unveiled a proposal which, if enacted, would bring sweeping changes to the Internet Governance landscape. A Senate working group worked on the proposal for 6 months. Although it is not only focussed on IG, the report can be seen as a further indictment of ICANN, following French Secretary for the Digital Economy Axelle Lemaire's claim that the organisation is no longer the right place to discuss IG. more
Yesterday I participated in a panel at the International Consumer Product Safety Conference sponsored by the International Consumer Product Health and Safety Organization (ICPHSO) held at the European Commission in Brussels Belgium. This conference brings together the global community of product safety engineers, manufacturers, retailers, regulators, inspectors, and counterfeiting investigators. The role of online fraud and illicit product traffic is clearly one of the conference priorities. more

The recent announcement at the ICANN 50 London, by all stakeholder groups and constituencies comprising of ICANN's Generic Names Supporting Organization (GNSO) to endorse a joint statement in support of the creation of an independent accountability mechanism "that provides meaningful review and adequate redress for those harmed by ICANN action or inaction in contravention of an agreed upon compact with the community" is a very welcome development to the Multistakeholder framework. more
The transition of the IANA contract oversight is, of course, the topic du jour at ICANN 50 in London. From the sessions to the hallway banter, it's the hottest topic I can recall in ICANN's history. It's an inherently over-the-top political topic, merging partisan politics in Washington with Internet governance. On numerous occasions in Singapore, Larry Strickling raised the domestic politicking on the part of the Republican Party regarding the IANA oversight transition, cautioning us of the discourse fuelled by opportunism. more
By now anyone who's part of the domain investment or broader ICANN community is aware of the curious saga of the recently launched .XYZ registry. Soon after its young CEO boldly stated, "we hope to reach 1 million .XYZ registrations in the first year and 5 million registrations in the first three years", the registry launched with a remarkable total of nearly 18,000 registrations on its first day, a total that has quickly grown to more than 100,000. But it was soon noted that "the zone files showed that over 70% of all .XYZ registrations had been made at NetworkSolutions... more

The Internet is not new. It has existed, in one form or another, since the 1960s. Since that time, it has been primarily the domain of the engineers and the other technology-minded individuals that built it. The organizations that were put in place to govern it predate the huge growth in end users the Internet experienced in the 2000s... They are able, in structure and capacity, to deal with technological issues. The issues facing the Internet in 2014, however, are very different from those in 1998. more
New gTLD Applicants now have a more fair and reasonable ICANN auction framework. A collaborative negotiation between the New TLD Applicant Group (NTAG) Auctions Working Group and ICANN Staff resulted in changes that improve the auction rules and bidder agreement. The indemnification and waivers in the agreement are now aligned with breaches that applicants can control. Applicants also now have an indemnification from Power Auction for third party claims related to IP infringement. more
When Steve delBianco from NetChoice testified (April 2, 2014) in the Subcommittee on Communications and Technology of the US House of Representatives on "Ensuring the Security, Stability, Resilience, and Freedom of the Global Internet", he proposed a stresstest for new mechanisms which could substitute the role of the NTIA in overseeing the IANA contract with ICANN. Stresstests are good. It is good for cars, it is good for banks and it is good for new mechanisms... more

Now, let's consider how a programmer would design new mechanisms to accomplish this transition. For starters, a programmer would need something more than high-level principles. Coding requires use cases for routine interaction and especially for cases where users don't follow the expected routine and where the real world intervenes with inconvenient problems. more
Two weeks ago, the US government announced it would transition its role in the IANA functions to the global Internet community. It tasked ICANN with the job of arriving at a transition plan and noted that the current contract runs out in 18 months' time, 30 September 2015. This week, ICANN started that process at its meeting in Singapore. And on the ground were the two key US government officials behind the decision. more
While the Internet governance debate devours headlines, it's almost easy to forget that ICANN is in the midst of the most audacious and important policy process it has ever undertaken. And while many new generic top-level domains are now live, the process of ensuring the best opportunity to fulfill their potential is not yet complete.
