I think we are all hoping that when ICANN meets with the DPAs (Digital Protection Authorities) a clear path forward will be illuminated. We are all hoping that the DPAs will provide definitive guidance regarding ICANN's interim model and that some special allowance will be made so that registrars and registries are provided with additional time to implement a GDPR-compliant WHOIS solution. more

Clearly whatever it is that Dutch politician Geert Wilders wants to talk about in his film is going to be the end of the internet. The news that Network Solutions decided to pre-empt his use of a domain name registered through them for the purpose of promoting his film need not be re-hashed here. However, before bemoaning yet another registrar freely deciding, as is its right, with whom it chooses to do business, it's important to look at the big picture. No, it is not "censorship" for Network Solutions to decide how it wants its services to be used... But, perhaps we might understand Network Solutions policy more clearly by looking at domain names registered through NSI... more
ICANN seems to be out to re-prove Hirschman's theories of exit, voice, and loyalty by driving all of its good people to exit rather than giving them meaningful voices. Thomas Roessler, a long-time advocate of individual users' interests on the interim ALAC now suggests it's Time to Reconsider the structure of ICANN's At-Large, as he feels compelled to promise himself not to get involved with ICANN again... more
Startups in the process of selecting a company or product name are often frustrated to see that someone else, years ago, registered the .com version of their newly thought-of name. Similarly, companies that have acquired a trademark registration wonder whether they can use their crisp new registration certificate to stomp out someone else who has been using a domain name similar to the company's new mark. A recent case arising under the UDRP shows us that the earlier domain name registration is usually going to be on solid ground against a later-arriving trademark owner. more
Brownian motion is the ceaseless random movement of particles suspended in a warm fluid. The particles move because they are buffeted by random collisions with molecules and atoms speeding this way and that under the impetus of heat. The greater the heat, the greater the motion. But no matter how much motion and how much heat, Brownian motion brings no progress.
Today I learned from Bret Fausett's ICANN Blog that ICANN has just published its Sixth Status Report Under ICANN/US Government Memorandum of Understanding, dated March 31, 2003. It's coming up on two years since the DomainKeys Identified Mail (DKIM) standard was published. While we're seeing a certain amount of signed mail from Google, Paypal, and ESPs, there's still a long way to go. How hard is it to sign your mail with DKIM? The major hurdle might seem to be getting mail software that can sign outgoing mail. more

Hundreds of individuals from across the Internet community have spent countless hours over the last several months crafting plans for the transition of the stewardship of the IANA functions from NTIA to the global multistakeholder community. The fruits of that labor have become highly evident within the past weeks, as two out of three components of the transition plan obtained the consensus of their communities while the third continued its intensive progress. more

As the second Internet Governance Forum approaches, it is an appropriate moment to take stock of how the Internet Governance dialogue has evolved since the conclusion of the WSIS Summit in 2005. One year after the first IGF in Athens, it is clear that government, industry and civil society stakeholders are still grappling over the direction and focus of the IGF... There is little doubt that some governments will choose to borrow concepts from the IGF when developing law and policy and will ultimately apply them to the Internet within their respective jurisdictions. Given the global nature of the Internet, this should be a fundamental concern. While this important dialogue about the Internet continues at the IGF in Brazil next month, another no less important debate is emerging with regard to RFID technology and the so-called "Internet of Things." The Internet of Things is a term coined to describe a future ubiquitous sensor network that collects commercial and personal data in public and private settings created, in part, through the rollout of RFID technology... more
