If a UDRP panelist believes domainers are the same thing as cybersquatters, is he fit to arbitrate? I came across an editorial on CNET today by Doug Isenberg, an attorney in Atlanta and founder of GigaLaw.com, and a domain name panelist for the World Intellectual Property Organization. The guest editorial focuses on Whois privacy and why it's imperative to maintain open access to registrant data for intellectual property and legal purposes. That's a common opinion I've read a million times. Nothing groundbreaking there. But then I was shocked to read that Isenberg generalizes domainers as cybersquatters: "Today, cybersquatters have rebranded themselves as 'domainers.' Popular blogs and news sites track their activities..."
One of the best sources of information about sites on the web is the Whois database. A trio of patent applications from Go Daddy, published last week at the US Patent and Trademark Office, explores whether adding additional information to the Whois database might help reduce spam, phishing, and other fraudulent practices and improve search engine results. The patent filings from Go Daddy would add reputation information to the published Whois data to let others use it for a number of reasons, including enabling search engines incorporate it into their ranking mechanisms. ...The patent application from Google focuses upon fighting web spam using a wide range of data, including that associated with domain names. ...We can't really be certain that Google is presently using this information, but there are some indications that they may be...
A few weeks ago ICANN's domain name policy making organ (the GNSO) decided that the purpose of Whois was domain name coordination and not compulsory surveillance of domain name registrants. The US and Australian governments expressed their opposition. The US government's lack of concern for privacy is well known. But what about Australia? The Australian ICANN Governmental Advisory Committee (GAC) representative, Ashley Cross, tried to use his authority as "a government" to intimidate the GNSO, sending it a message announcing that "Australia" supports a broader definition of Whois purpose that gives ICANN a blank check... What does "Australia" really support, however?
Today's Wall Street Journal discusses the fight over Whois privacy. The article on the front page of the Marketplace section starts by discussing how the American Red Cross and eBay use the Whois database to track down scammers: "Last fall, in the wake of Hurricane Katrina, the American Red Cross used an Internet database called "Whois" that lists names and numbers of Web-site owners to shut down dozens of unauthorized Web sites that were soliciting money under the Red Cross logo. Online marketplace eBay Inc. says its investigators use Whois hundreds of times a day..."
I had the pleasure of eating breakfast with Vint Cerf, chairman of ICANN's board and Chief Internet Evangelist at Google, prior to his keynote address this morning. It was great to discuss some of the issues domainers are facing with regards to registrar practices, expiring domains, etc. directly with Cerf. Cerf's keynote kept the crowd engaged. I've summarized the topics he covered... Some people have misunderstood Cerf's position with regards to adding new domains. He said he is not opposed to adding new TLDs. What he advocates, however, is having a solid rationale for adding new TLDs. Cerf believes the processes and outcomes of the first two rounds of TLD adds were not satisfactory...

And the results were a decisive defeat for the copyright and trademark interests and the US government, and a stunning victory for advocates of the rights of individual domain name registrants...

A recent report released by Forrester Research last week has put the .travel sponsored top-level domain under the microscope -- calling the sTLD "Nice, But Not Necessary". Although this 4-page report (sold for US$49.00) has singled out the .travel domain, its critical arguments might very well apply to the nature of most sponsored top-level domains currently in existence -- or under review: '.mobi', '.jobs', '.museum', '.coop', '.xxx' and others. In a recent article, eWeek reports on researchers at Microsoft revealing large-scale, typo-squatting schemes that use "multi-layer URL redirection to game Google's AdSense for domains program". According to this report, the Microsoft Research Systems Management Research Group succeeded in tracking a ring of typo-squatters registering misspelled domain names that generated traffic for serving advertising from Google.
