David Pecker is the chairman of American Media, Inc., publisher of, among others, National Enquirer and Weekly World News. 'Mr. Ferris' registered the domain name DAVIDPECKER.COM, had a PPC company host it, where it was keyed to ads for porn, because, according to the registrant, the word PECKER was in the domain name. Mr. Pecker brought a UDRP. Although 'Mr. Ferris' (as he is identified in the decision) did not seem (to me) that he could establish a bona fide intent to use the name in conenction with an offering of goods or services, and altohugh there seemed to be plausible evidence of bad faith, the UDRP was denied... more
To say that it's been quite a year in the world of domain names would be an understatement. From compromised country code Top-Level Domains (ccTLD) registries, to the delay of new generic Top-Level Domains (gTLDs), some of the events of the past year have been surprising, while others could easily have been predicted. ICANN's expansion of top-level domain program faced a second hearing today (see last week's Senate Committee hearing here), this time by the Subcommittee on Communications and Technology of the House Energy and Commerce Committee. During the hearing critics once again warned that ICANN's January roll-out of the program is not adequately developed and it should be delayed. According to an article in the October 15, 2004 INTA Bulletin, several new "Policies Applicable to ICANN-Accredited Registrars" will be implemented by the end of 2004. The new Restored Names Accuracy Policy tales effect November 12 and requires that a domain name that was deleted due to the submission of false contact data or lack of response to a registrar's inquiries... more
Electronic Frontier Foundation (EFF) released a letter today stating "companies and organizations that run the Internet's domain name system shouldn't be in the business of policing the contents of websites, or enforcing laws that can impinge on free speech. more
The Coalition Against Domain Name Abuse (CADNA) has released a report today suggesting that the Internet Corporation for Assigned Names and Numbers' (ICANN) anticipated launch of 400 generic top-level domains (gTLDs) could cost brand owners worldwide over $746 million. "CADNA's findings are based off a document released by ICANN last month regarding the expected number of gTLDs, or the letters found after the last dot of a domain name like .COM or .ORG, that will be created during the first round of the TLD launch." On the other hand, Earlier this year, Minds + Machines reported on an analysis predicting new gTLDs will only cost $.10 per trademark worldwide. more

I will try and take a different approach with this post. There are two elements of WLS that I think are most material and are not discussed often enough. They are i) the scope of the original NSI-ICANN contract and ii) the use of multiple accreditations.
...Verisign is paid a sum of money to perform a service. They own neither the primary nor the secondary data. I will not bore you with a recitation of various sections of the agreement nor with long-winded legal arguments. They are for another forum. The implication of this conclusion as it relates to WLS is that any re-registration market service is outside the scope of the original contract and should be treated as any new service should. more
In Part 1 and Part 2 of this series of blog posts I described the need for a registration operations industry association. At the end of Part 2, I wrote that Part 3 will describe "an opportunity for everyone that's interested in discussing this topic in a live environment." The large number of people attending ICANN 51 in Los Angeles presents the best chance of discussion with many potential participants being in the same place at the same time. Internationalized (non-ascii) domain names (IDN) are a key issue for ICANN. Yesterday, the Board completed two days of workshop presentations about various matters (IANA, security, GAC relationships), and we were briefed on the IDN testing that is planned. I thought it might be useful to make clear the distinction between the tests (which are testing mechanisms for IDNs) and the very difficult policy questions that confront ICANN. As several people explained to me yesterday, they're different. more
ICANN Compliance now has two conflicting answers on record concerning the enforceability of RAA 378 on WHOIS inaccuracy. This is a topic of extreme importance and one we are trying to get to the bottom of. ...inconsistency needs to be resolved as it directly impacts the current RAA negotiations and certainly before new gTLDs are deployed. more
