Its inability or unwillingness to date to reign in bad WHOIS policy, driven by contracted party interests, flies in the face of its previously-expressed policy goal “to ensure the continued availability of WHOIS to the greatest extent possible while maintaining the security and stability of the Internet’s system of unique identifiers.” more
In April, I published an article, The Multistakeholder Moment of Truth: Will Stakeholders Hold ICANN Accountable?, alerting stakeholders that ICANN is violating its legal agreements with the U.S. Government -- namely the InterNIC licensing agreement and merged Memorandum of Understanding. Technical management of the Internet was delegated to ICANN by the U.S. government because it was believed that the private sector would be more agile and responsive to the needs of globally distributed stakeholders. However, this optimism and the faith it has produced has proven to be misplaced since ICANN's multi-stakeholder governance continues falling far short of the basic expectations set when it was created. more
A recent study carried out by Governance Primer on behalf of the Universal Acceptance Steering Group (UASG) identified trends in the acceptance of all domain names in software hosted at Github, the largest open-source repository globally. This research builds on top of previous efforts aimed at identifying the underlying issues that result in problems when different applications need to handle Internationalized Domain Names (IDNs) and new gTLDs, particularly when it comes to email addresses. more
During last week's ICANN71 Virtual Policy Forum, the Brand Registry Group (BRG) held a very informative session about how ICANN can help potential applicants prepare for the next new gTLD round. Speakers during the session provided historical perspective that applicant guidebooks have regularly evolved over time as a result of community review and feedback provided to ICANN, providing concrete examples of how the current applicant guidebook was developed. more

On May 26, 2021, I submitted a complaint to ICANN's Complaints Officer, Krista Papac. In a nutshell, my complaint centers on ICANN's blatant violation of its Bylaws, specifically Section 2.2, named Restrictions, which expressly prohibits ICANN from acting as a registrar. However, despite the absence of any exceptions to this unambiguous prohibition, ICANN is acting improperly as a registrar for the purposes of warehousing and cybersquatting on certain domain names in the .com and .net registries. more

Threats to the integrity and security of the DNS have become a regular topic of debate within the ICANN community. It has been just over 3 years since the General Data Protection Regulation (GDPR) came into effect, and the work within ICANN (type "EPDP 2a" into your acronym decoder ring) to develop a permanent Registration Data policy is progressing at a snail's pace. At issue is a proposed mandatory requirement for Contracted Parties (really just Registrars), to differentiate between "legal persons" (a fancy way of saying corporations and similar organizations) and "natural persons" (the kind that eat and breathe and schedule Zoom calls). more
Last month saw a much-anticipated decision handed down in the Independent Review Panel (IRP) proceeding examining the controversial 2015 auction for the .web generic top-level domain name registry (gTLD). This decision has been covered by others, including Kevin Murphy's DomainIncite, and has been the subject of unsurprisingly incongruous statements by both Verisign and Afilias, who are both contending for the .web concession privilege. more

In September 2015, John Levine asked why ICANN should be considered a tax-exempt organization following the completion of the U.S. government's transition of technical management of the Internet's Domain Name System (DNS). The U.S. Internal Revenue Service (IRS) determined that ICANN was an exempt organization in 2000 and, inarguably, circumstances have evolved materially since then. more
The report, "A Decade of Passive DNS" provides a longitudinal analysis of the use and popularity of top-level domains over a ten-year period. The findings are based on what Farsight Security has seen in passive DNS from 2010-2019 based on a ten-year data rollup, excluding DNSSEC-related records. This study allows us to report on four measures for that period for each of the 1,576 IANA-recognized TLDs. more

This theme has been rising in prominence every year since 2018, and 2021 appears to be the tipping point, in which consensus has built around the idea that more can be accomplished in terms of reducing the impact of rogue actors using the Internet for malicious purposes. more
