If we traveled back in time, we would discover that unauthorized squatting on someone else's property is an ancient tort, but in cyberspace, it dates from the mid-1990s. Its emergence brought together governments and intellectual property stakeholders to demand a rights protection mechanism devised to deal with this new form of squatting. In 1999 the World Intellectual Property Organization (WIPO) completed its work on a proposal for an online rights protection mechanism which ICANN crafted into the Uniform Domain Name Dispute Resolution Policy (UDRP). more
Earlier this month, MarkMonitor representatives were privileged to witness, at the first ICANN meeting of 2016 in Marrakech, Morroco, the historic presentation of the plan to transfer the stewardship of key internet functions (IANA) from the United States Government to a community and consensus-based model of governance through ICANN (Internet Corporation for Assigned Names and Numbers). more
It makes the strategist in my heart sing when I see that most of the new gTLDs labeled generic are in fact words that speak to a specific niche. Most are even so specific that the average person, a friend sitting next to you at a dinner party, your parents, can understand how a space online dedicated to that word might be a reasonable option for that audience and the names they chose online. And then inevitably you are forced to trot along the path of 'what about .com??!' with said dinner party guest. more
The launch of a new or repurposed Top-Level Domain (TLD) is always surrounded with speculative activity. Some domainers will register domains in the new TLD with hopes of getting rich quick. Others will do so because the same domain in .com is worth a lot of money. And then there are the developers who see the prospect of building a carefully branded website in the new TLD. And with all those proposed new generic Top-Level Domains (gTLDs), this cycle will be repeated. But what does a Domain Name Land Rush look like? more
The ICANN meeting in Nairobi starts officially next Monday. However, as is normally the case, by the time Monday rolls around people will already have been working since Saturday morning (if not earlier). All ICANN meetings seem to be surrounded by some bit of controversy and excitement, but the Nairobi meeting is possibly more dramatic than many others. The last attempt to hold a meeting in Nairobi failed, with ICANN opting to hold the meeting near LA's airport, LAX, instead. more
The .uk launch today has been getting quite a bit of press coverage. Getting a big name celebrity like Stephen Fry to endorse the shorter namespace is also a nice win for Nominet. As part of the PR around the launch they've also put out a big welcome sign near Heathrow airport... It'a a bit ironic though as .uk isn't exactly welcoming to non-UK individuals or companies. more
When I began writing about the dot-org sale, it was out of concern for the loss of what I felt strongly was long understood to be a unique place in the Internet's landscape. Like a national park, dot-org deserved special protection. It turns out lots of people and organizations agreed. On April 30th, 2020, The ICANN Board upheld these values. They unanimously withheld consent for a change of control of the Public Interest Registry to a private equity firm. more

The new Top-Level Domain (TLD) program was designed from the outset to enhance competition and foster innovation. It was a great result for the wider industry to see approximately one-third of the applications received by ICANN submitted by some of the world's largest companies seeking to own and operate their own .brand TLD. Even with organisations such as Apple, Citibank and IBM applying for their respective TLDs, scepticism remained on the potential for .brands to succeed. more
Registrars who support .com domain names will use the Extensible Provisioning Protocol (EPP) system by October 28. ...There will be an additional step when trying to transfer a .com domain name among registrars. Specifically, a piece of information called an EPP code (aka auth code, EPP key, transfer secret) must be obtained from the current registrar and submitted to the gaining one prior to approving with the latter. more
Back in September of 2020, ICANN CEO Göran Marby wrote a blog post discussing the implementation of "a common strategy for Internet governance (IG) and technical Internet governance (TIG)", raising the question of whether the ICANN org. intended to pursue this distinction moving forward, as debated in a previous article. The fourth quarter of 2014 closed with a base of 288 million domain name registrations across all top-level domains (TLDs), an increase of four million domain names, or 1.3 percent over the third quarter of 2014, according to Verisign's latest Domain Name Industry Brief. Registrations have grown by 16.9 million, or 6.2 percent, year over year. Total country-code TLD (ccTLD) registrations were 134.0 million domain names, a 1.5 percent increase quarter over quarter, and an 8.7 percent increase year over year. more
Drawing on standard-setting approaches and the regulatory options at the disposal of the Federal Communications Commission (FCC), I outline three alternative venues to decide on launching new top-level domain names (TLDs). ICANN needs to analyze all these venues before making a final procedural decision. more
