Recently, the Internet Corporation for Assigned Names and Numbers (ICANN) unveiled its Trademark Clearinghouse (TMCH), a tool it proposes will help fight trademark infringement relating to another of its new programs - generic top level domain (gTLD). As Lafeber describes, criticism of ICANN's gTLD program and subsequent TMCH database is mounting. Skeptics have noted that given the significant cost of registering a gTLD - the application fee is $185,000 and subsequent annual fees are $25,000 - the program appears to be solely a cash cow, without adding much value to Internet users. more

Wait and see approach on abuse attracts ICANN Stakeholder attention: A few weeks ago I made a detailed argument as to why product safety applies to domains, just like it does to cars and high chairs. I also argued that good products equal good business or "economically advantaged" in the long run. ICANN's Board Governance Committee (BGC) today released its comments on recent reconsideration request of dotgay LLC's new top-level domain .GAY application. Kevin Murphy from Domain Incite reports: "ICANN has refused dotgay LLC's latest appeal against adverse .gay decisions, and has taken the unusual step of preemptively defending itself against probably inevitable accusations from gay right groups." more

With much fanfare last month, Uniregistry announced that proposals for dispute resolution between New TLD applicants in lieu of ICANN's so-called "Auction of Last Resort" posed significant antitrust risks. Their claim of concern was not based on any critical antitrust analysis, but rather on the fact that they had sought a "Business Review" letter from the Antitrust Division of the U.S. Department of Justice (DOJ), and, according to Uniregistry, the DOJ failed to provide them a positive response and discussed the issue with them. more
When ICANN committed -- after no small debate -- to an open, rather than limited application process for new gTLDs, supporters likened it to "letting a thousand flowers bloom." ICANN reports that Google paid over $25 million for .APP in the February 25 domain auction. They were willing to bid $30M, but it's a second bid auction so that was just enough to beat out whoever the second highest bidder was. The auction proceeds piggy bank just nearly doubled from $34M to about $59M dollars, and ICANN still has no idea what to do with it. more

The Internet Corporation for Assigned Names and Numbers (ICANN) has released new guidance concerning the reporting and disclosure of bugs that affect the Domain Name System, including information of how ICANN itself will behave in response to vulnerabilities. Until recently, ICANN, which is responsible for maintaining the root domain servers at the heart of the DNS system, had no specific guidelines for the reporting of vulnerabilities, leaving responsible disclosure protocols up to the researchers who discovered the bug. more
One of the ever-present questions in the domain name community is "have new TLDs been a success in the marketplace?" As many within the industry will appreciate, it's a difficult question to answer using traditional metrics (such as domain registration volumes), and it is important to remember that the new TLD expansion in 2012 was all about diversity, competition and choice. more
In comments to the U.S. Government, ICANN sought to convince the National Telecommunications and Information Administration (NTIA) to relinquish its oversight of the Internet Address and Number Authority ("IANA") functions. At its heart, ICANN's presentation is a plea for NTIA to declare the privatization of DNS management finished. For several reasons, ICANN's plea should be refused. more
The termination of ICANN-accredited registrar EstDomains is to go ahead, effective 24 November 2008. On 28 October 2008, ICANN sent a notice of termination to EstDomains, Inc. based on an Estonian Court record reflecting the conviction of EstDomains' then president, Vladimir Tsastsin, of credit card fraud, money laundering and document forgery. Pursuant to Section 5.3 of the Registrar Accreditation Agreement (RAA), ICANN may terminate the RAA before its expiration when, "Any officer or director of [a] Registrar is convicted of a felony or of a misdemeanor related to financial activities..." more
