Explaining the Legal Enforceability of the PIC Proposed by Ethos for .ORG

Ethos Capital has recently announced that it has voluntarily proposed to add an amendment to Public Interest Registry's (PIR) .ORG Registry Agreement with ICANN in the form of a Public Interest Commitment, also known as a "PIC." In the press release Ethos indicated that the PIC would become "legally binding" and "enforceable" both by ICANN and by members of the community. First Four TLDs Pass Pre-Delegation Testing

The first four new Top Level Domains (TLDs) have passed pre-delegation testing. Historically, it has taken most companies about 9 months after the Registry Agreement is signed before domain names go on sale to the general public. The four TLDs signed Registry agreements in April 2013. These TLDs may begin to sell domain names to the public as early as December 2013 or January 2014. more

When there is money on the table, and when global politics are invoked to one degree or another, it is the lawyers who are tasked to translate lofty goals into precise words on paper that will survive the inspection of judges and courts. ICANN Names Steve Crocker as Chair of the Board

ICANN has named, Internet pioneer, Steve Crocker as new Chair of the Board. Dr. Crocker whose involvement with ICANN dates back to 2002, has also served as chair of ICANN's Security, Stability, and Advisory Committee (SSAC) until 2010. He was the SSAC liaison to the Board from 2003 to 2008, a voting member of the Board since 2008, and vice-chair of the Board since December 2010. Crocker succeeds Peter Dengate Thrush, who was Chair since 2007. Also board member Bruce Tonkin, an Australian, was named Vice Chair. He is currently the Chief Strategy Officer for Melbourne IT Limited. more

ICANN Voting to Pull the Weeds is Good - Pulling Them is Even Better

At the ICANN Public Forum in Singapore yesterday, I likened the ICANN to a community garden: fertile, colorful and above all, worthwhile, but not without a few troublesome weeds. Today's Board vote to adopt the recommendations of the Accountability and Transparency Review Team (ATRT) is a vote to pull those weeds. As good as voting for this weed-pulling exercise is, completing it will be even better. more

Likely Timeline to New gTLD Delegation With Batching

Today, the team at ARI Registry Services decided to tread where no-one has tread before and map out the likely timeline to new gTLD delegation with batching. The exercise took some time, given that the information provided in the Applicant Guidebook is limited and there hasn't been any specific public data made available. However, we have presented what we believe to be the likely scenario should ICANN proceed under the current batching model, assuming a first batch of 500 applications. more

Sen. Ted Cruz is circulating a new bill that would prevent the IANA transition without approval from Congress. "Cruz began circulating the legislation last week to colleagues with background information that called it 'our last chance to save internet freedom.'" more

Cruz and Co Send ICANN Another Letter

Republican Presidential hopeful Ted Cruz (and others) has sent yet another letter to ICANN. This time round, the letter is addressed both to the Chairman of the ICANN Board, Dr Steve Crocker, as well as to former CEO Fadi Chehadé. The letter repeats some of the questions previously put to ICANN, though the wording is much blunter this time round. Cruz' office issued a press release with details of the letter under the title of "ICANN Is Stonewalling the U.S. Congress". more
