Highlights from ICANN67 Public Forum – Community Dialogue on Proposed Transfer of PIR Ownership

Ethos CEO Erik Brooks and I are grateful to ICANN for hosting this important community dialogue on the future of PIR and .ORG earlier this week, and we listened intently to the questions posed. To echo what John Jeffrey said in his opening remarks, we are very interested in the community's input. NTAG Chair Blog: The Road Ahead

The next six months will be a pivotal period in ICANN & New gTLD applicant relations. April 2014 will mark one year since the Governmental Advisory Committee - better known as the GAC - issued advice that put nearly 400 applications on hold. The Name Collision issue, while no longer a gate for many applicants, currently puts thousands of second level domain names on hold. March will be a key inflection point for this issue as well. more

It’s Time for a Referendum on Orgxit

The worst thing about Brexit wasn't the referendum. It was the fallout. David Cameron decided that the best way to manage a small risk was to take a big one. Finally, over three agonizing years later, the UK looks set to move on. The Internet Society – which has run the .ORG domain since 2002 – was in the same position as Cameron. They became convinced that it was worth dealing with a small risk by taking a huge one. more

NTAG Chair Blog: A Better Auction Framework

New gTLD Applicants now have a more fair and reasonable ICANN auction framework. A collaborative negotiation between the New TLD Applicant Group (NTAG) Auctions Working Group and ICANN Staff resulted in changes that improve the auction rules and bidder agreement. The indemnification and waivers in the agreement are now aligned with breaches that applicants can control. Applicants also now have an indemnification from Power Auction for third party claims related to IP infringement. more

ICANN Sued in an Attempt to Block .WEB Auction

Controversy over .WEB auction takes a new turn as various sources today pointed to a lawsuit filed against ICANN by Ruby Glen LLC, a subsidiary of Donuts Inc. -- the largest registry for new generic top-level domains (gTLDs). more

Multi-Stakeholder Internet Governance Is Captured and Presumed Dead

Technical management of the Internet was delegated to ICANN by the U.S. government because it was believed that the private sector would be more agile and responsive to the needs of globally distributed stakeholders. However, this optimism and the faith it has produced has proven to be misplaced since ICANN's multi-stakeholder governance continues falling far short of the basic expectations set when it was created. more

A Patchwork Quilt: Abuse Mitigation, the Domain Naming System and Pending Legislation

A few weeks ago, Appdetex published a blog with predictions for 2021, and admittedly, at the date of publication, there were already very clear indications that one prediction was already in flight. In our blog post, we'd said, "With the global domain name system failing to abate abuse, and, in fact, thwarting consumer protection, get ready for a patchwork of local laws targeting attribution and prosecution of bad actors... Get ready for some confusion and turmoil in the world of notice and takedown related to local laws and regulations." more

An Open Response to “Stop Obama’s Internet Giveaway”

It seems necessary to publicly address the arguments posed in "Stop Obama's Internet Giveaway" by L. Gordon Crovitz of the Wall Street Journal. If, as Crovitz suggested, the President were truly "giving away the Internet," there would be mass outrage. After all, the Internet has become a primary driver of global commerce. Internet users, businesses, civil society members and Internet operators have come together to approve a set of proposals to make the Internet stronger and more open. more

ICANN Makes Senior Management Restructure to Fix Organizational Weaknesses

Kieren McCarthy reporting in .Nxt: ICANN's new CEO Fadi Chehade has embarked on a bold restructure of the organization's management on his first day in the job. Announcing two new senior management members -- Sally Costerton as head of stakeholder relations and communications and Tarek Kamel as head of governmental affairs -- Chehade says his focus was on engaging at a global level with stakeholders, building relationships and improving accountability. more

Enough’s Enough: It’s Time to Set a Deadline for the Next New gTLD Application Window

The ICANN community is currently in full congratulatory mode because the team responsible for the delivery of the Phase 1 Final Report of the Expedited Policy Development Process on gTLD Registry Data (EPDP) has managed to do so in a record-breaking seven months. The GNSO Council approved the Final Report in a special meeting on 4 March 2019, and the report will now be sent to the ICANN Board for consideration and hopefully adoption. more

A 1998 IANA Technical Seminar I Will Never Forget

In 1998, I was a lawyer working at Jones Day in Los Angeles, specializing in patent lawsuits. Specifically, I was a member of Jones Day's Technology Issues Practice, which sought to assist companies becoming involved in computer and communications technologies, including the Internet. Meanwhile, in early May the Internet Assigned Numbers Authority (IANA) was preparing to transition its home base from the University of Southern California's Information Sciences Institute (ISI) to a new, independent and not-for-profit organization. more

A New Low for the ICANN Multistakeholder Process

ICANN's dismissal of public comments submitted on the .COM Registry Amendment wasn't surprising given that it recently dismissed the public comments on the .Org Renewal Agreement, but the speed and disdain which it demonstrated was. Attacking DNS Abuse: The Next Amendments Needed

Abusive behavior that leverages the domain name system (DNS) continues to be a problem, with a reach that has been widely and credibly documented. There is little doubt that bad actors continue to use the DNS for nefarious and costly purposes. While the amendments made in 2024 to ICANN's Registry Agreement (RA) and Registrar Accreditation Agreement (RAA) were a step in the right direction, more advanced tools are needed to bring abuse rates down. more

DCA Trust Strongly Urges ICANN Board Not to Adopt the Proposed Amendment to Its Bylaw

ICANN has been busy in managing several parallel processes that are also closely tied together in one way or the other. The processes include the new gTLD process, the IANA transition and most currently and important action yet that would act as the synergizing factor is the accountability process. ICANN has also posted for public comment proposed Bylaws revisions that would incorporate a higher voting threshold for the Board to determine not to follow the advice of the Governmental Advisory Committee. more

4 Items for Applicants to Consider in Planning, Even As You Wait

With the effective deregulation of the domain name industry through the imminent launch of up to 1,000 new gTLD's, the competitive landscape is going to get a whole lot hotter over the next 24 months. We will likely see some financially and commercially successful ventures. It is likely that we will see many unsuccessful ones as well. The gap between success and failure will be slim. more
