Thinking Carefully About New gTLD Objections: Limited Public Interest (Part 2 of 4)

The second installment in my four-part series on New gTLD objections will focus on the limited public interest ("LPI") variety. The overarching theme however is essentially the same: new gTLD objections are generally more complicated (and costly) than UDRP actions and need to be approached with care. In fact, LPI represents one of the best examples of the tough climb that would-be objectors are likely to face. Understanding exactly what is required beforehand - and whether or not you can deliver - is absolutely critical. more

CENTR Paper on Fifth World Telecommunication/ICT Policy Forum

Many nations, particularly from the developing world, look to the International Telecommunications Union (ITU) for advice on telecommunications issues and, increasingly, Internet governance issues. The ITU's Fifth World Telecommunication / ICT Policy Forum (WTPF-13), 14-16 May 2013, Geneva, Switzerland, will be the first WTPF to focus exclusively on Internet issues. more

I’m Impressed by Fadi

I could have ignored yesterday's ICANN New gTLD Applicant Update Webinar and just read summaries from the usual respected news and industry sources. However, with three hours slotted and likely questions regarding ICANN CEO Fadi ChehadĂ©'s somewhat eyebrow-raising comments at the regional ICANN Registry-Registrar meeting in Amsterdam last week -- led me wanting to hear it all myself. more

The Favoured New TLD Registrar Payment Model

This week, Thomas Barrett - the President of US based registrar EnCirca - published a timely article about how the registrar cash flow model could collapse with the imminent release of hundreds of new Top-Level Domains (TLD). I would like to thank Thomas for raising this important issue and for encouraging all new TLD applicants to discuss this topic with their back-end registry provider. more

Thinking Carefully About New gTLD Objections: String Confusion (Part 1 of 4)

Since speaking last fall on community-based TLDs at the New gTLD Summit in Los Angeles, I have been asked a number of times to provide input on the objections ICANN allows in its New gTLD Applicant Guidebook ("AGB" or simply the "Guidebook"). As the March 13 deadline approaches, I now present the first of a series of four spotlight articles on the subject -- one on each of the four permissible grounds for objection. more

Preparing for the Launch of the Trademark Clearinghouse

With the Trademark Clearinghouse (TMCH) expected to begin accepting submissions within the next month or so, many companies are now attempting to identify marks for inclusion. As a reminder, the TMCH is a centralized repository of validated rights which will be used in support of ICANN's New gTLD Program. Submissions to the TMCH enable brand owners to register their trademarks as domain names during so-called Sunrise Periods. more

Marketing Activities for New TLDs That Can Start Right Now

Sitting on the plane after a tightly packed 3 days in Amsterdam for the regional registrars meeting, I'm bursting with ideas and thoughts. The highlight of the event for me was the meeting organized by Google to propose the creation of a trade association on behalf of TLDs. Brilliant and long overdue. The comedy of the situation the domain name industry has lived with since its inception is the fact that it actually doesn't exist in the eyes and minds of the average business or consumer. Domain names are simply a by-product of websites, or possibly even web-hosting.  more

Loopholes and Ambiguities in Contracts that ICANN Oversees

ICANN oversees the creation of many contracts. Its highest paid contractor has historically been the law firm of Jones Day, and of course ICANN has many lawyers on staff. In the past I've identified loopholes in proposed contracts, and those were corrected before they were exploited. However, are there other loopholes sitting in existing contracts waiting to be exploited, or ambiguities with major financial consequences depending on their interpretation? more

The Upside of Losing at New gTLD Auction

On eBay, a Virgin Mary Grilled Cheese Sandwich sold for $28,000, a ghost in a jar for $55,000, and a Corn Flake shaped like the state of Illinois $1,350. In each of these very real examples, auction participants placed significant value on the items they were pursuing, in spite of their questionable value. These lucky eBay winners may have also received a case of Winner's curse... Unfortunately, human beings are not always rational and information is rarely - if ever - perfect. So how do you avoid winner's curse for your TLD? more

FTC Chief Concerned Over Most New gTLD Bids

Kevin Murphy reporting in DomainIncite: The US Federal Trade Commission is still "looking at" ICANN's new gTLD program amid concerns that most of the applicants applied defensively, it has emerged. ... "We have been very, very concerned about ICANN and their dramatic expansion of the domain names, which we think will cause consumer confusion and even worse lead to more areas where malefactors can hide from the law while defrauding consumers," FTC chairman Jon Leibowitz said. more

The Results of the ICANN Bingo Are In!

A few early technical hiccups with the system streaming it live did not prevent ICANN's prioritization draw from running smoothly yesterday, December 17, 2012. All 1917 remaining applications (out of initial 1930 announced last June) were processed in one of the meeting rooms at the Los Angeles Airport Hilton, starting at 13:00 local time. Shortly before midnight, or more than 10 hours later, Google's Dot MBA was the last application to be pulled out of the box. more

Wine Applications: Results of the New gTLD Prioritization Draw

There are 4 applications related to the wine business in the new gTLD program. Yesterday the new gTLD prioritization draw took place where each application was assigned a randomly-drawn priority number. These priority numbers are used to determine the order in which initial evaluation results are released. In the 1917 applications, 4 applications are related to wine. more
