According to the latest update from ICANN related to the introduction of new generic Top-Level Domains (gTLDs), Dr. Dennis Carlton has reiterated that the planned introduction of new gTLDs will not burden trademark owners with additional defensive registrations. Carlton writes: "I conclude that ICANN's proposed framework for introducing new gTLDs is likely to facilitate entry and create new competition to the major gTLDs such as .com, .net, and .org. Like other actions that remove artificial restrictions on entry, the likely effect of ICANN's proposal is to increase output, lower price and increase innovation. This conclusion is based on the fundamental principles that competition promotes consumer welfare and restrictions on entry impede competition." more
Twenty years ago (Monday) on June 8th, 1989, I did the public launch of ClariNet.com, my electronic newspaper business, which would be delivered using USENET protocols (there was no HTTP yet) over the internet. ClariNet was the first company created to use the internet as its platform for business, and as such this event has a claim at being the birth of the "dot-com" concept which so affected the world in the two intervening decades. Back in 2005 an organization called the Coalition for Internet Transparency (CFIT) burst upon the scene at the Vancouver ICANN meeting, and filed an anti-trust suit against VeriSign for their monopoly control of the .COM registry and of the market in expiring .COM domains. They didn't do very well in the trial court, which granted Verisign's motion to dismiss the case. But yesterday the Ninth Circuit reversed the trial court and put the suit back on track. more

ICANN staff recently posted on its website an updated timeline on the new gTLD process. Attempting to be "fair and balanced," I see some good, some bad, and some potential ugly in this timeline. I know there are a lot of good people at ICANN working very hard to conclude the Herculean task of implementing the new gTLD process. As reported last July, there is a proposal from some Flemish politicians to create a .vla top level domain under the new gTLD process launched by ICANN. The proposal further elaborated that the Flemish government would have to cover the costs. Not so fast, says the Flemish government... more
During the recent ICANN Board meeting in Mexico City, the Board authorized the creation and funding of an Implementation Recommendation Team (IRT). This team was to be comprised of "an internationally diverse group of persons with knowledge, expertise, and experience in the fields of trademark, consumer protection, or competition law, and the interplay of trademarks and the domain name system to develop and propose solutions to the overarching issue of trademark protection in connection with the introduction of new gTLDs." more
Nearly ten years ago, the Government of Canada wrote a letter to the chair of the Canadian Internet Registration Authority (CIRA) that set out the framework for the management of the dot-ca domain. The government articulated a vision of the dot-ca domain as a “key public resource” and called on CIRA to act in an open and transparent manner. CIRA has long sought to live up to those standards, but in recent months the organization has shown an unmistakable shift toward prioritizing commercial gain over the public interest along with a troubling move toward secret decision making... more
The Technology Policy Institute (TPI), an IT and communications policy think tank, has just released a paper proposing that "ICANN's governance structure should be dramatically reformed to make it more accountable before the current tie with the U.S. Department of Commerce is allowed to expire." The paper titled "ICANN At a Crossroads: a Proposal for Better Governance and Performance" is written by Thomas M. Lenard, President and Senior Fellow at TPI, along with Lawrence J. White, Professor of Economics at the NYU Stern School of Business. The 52-page study also asserts that ICANN must have a clear focus on encouraging competition with minimal role as a regulator with respect to the creation of new generic Top-Level Domains (gTLDs). more
The Mexico City ICANN Conference was more eventful than some of us had anticipated. Among the highlights was Paul Twomey's announcement that he is stepping down as President and CEO of ICANN effective on June 30... Wednesday's announcement by the Obama administration, that former Washington state governor Gary Locke has been nominated as the next Secretary of Commerce could be a good sign for Internet governance, and the continued globalization of the ICANN regime. The Chinese-American Locke brings key political capital and experience to the table. He is well respected within and has access to the most senior levels of the Chinese government... more
As a member of ICANN's Business Constituency I have heard first-hand the perfectly appropriate criticisms from trademark holders of ICANN's roll-out of new generic Top-Level Domains (gTLDs). But while it may be OK for branded companies to wish they didn't have to deal with the matter, the dust that has been kicked up has obscured real value in the program. more

As recently reported, spam volumes indicate spam has nearly jumped back up to its pre-McColo shutdown levels. However, Symantec's The State of Spam report has also observed that in recent days spammers are increasingly piggybacking on legitimate newsletters and using the reputation of major social networking sites to try and deliver spam messages into recipients' inboxes... In its special URL investigation the report also indicates that on average approximately 90 percent of all spam messages today contain some kind of a URL. Additionally, analysis of data from past recent days, according to Symantec, have shown that 68% of all URLs in spam messages had a '.com' Top-Level Domain (TLD), 18% had a China's '.cn' ccTLD and 5% had a '.net'. more
While doing research for a paper on telegraph codebooks, I was reminded of something I had long known: one could have short addresses for telegrams. A short article in The New Yorker described how it worked in New York City. Briefly, one could pick more or less any name that wasn't in use, and list it with the Central Bureau for Registered Addresses... more
