On May 26, 2021, I submitted a complaint to ICANN's Complaints Officer, Krista Papac. In a nutshell, my complaint centers on ICANN's blatant violation of its Bylaws, specifically Section 2.2, named Restrictions, which expressly prohibits ICANN from acting as a registrar. However, despite the absence of any exceptions to this unambiguous prohibition, ICANN is acting improperly as a registrar for the purposes of warehousing and cybersquatting on certain domain names in the .com and .net registries. more
I recently caught up with a former colleague Antony Van Couvering. Many here on CircleID probably know him, he's been active in the domain name business since the late 1990's. With the new Top-Level Domain (TLD) issue so white hot and with Antony's firm right in the mix, I thought it was time to get his take via an interview. Last week, The New York Times website domain was hacked by "the Syrian Electronic Army". Other famous websites faced the same attack in 2012 by the Hacker group "UGNazi" and, in 2011 by Turkish hackers. Basically, it seems that no Registrar on the Internet is safe from attack, but the launching of new gTLDs can offer new ways to mitigate these attacks. more
The reports and analysis by Dr. Dennis Carlton are deeply, deeply flawed. I will prepare a long rebuttal to it in the coming weeks, but wanted to go on the record early as to its weaknesses. The analysis appears to be based on a very limited review of the market for domain names, and utilizes little actual data. OK. Now my lawyer has given me the green light, I can officially announce I am working on a proposal for a .sport TLD, to be submitted to ICANN for consideration as a new TLD next year. There is still a long way to go in terms of getting the proposal ready, but I this this one is a winner... more
During last week's ICANN71 Virtual Policy Forum, the Brand Registry Group (BRG) held a very informative session about how ICANN can help potential applicants prepare for the next new gTLD round. Speakers during the session provided historical perspective that applicant guidebooks have regularly evolved over time as a result of community review and feedback provided to ICANN, providing concrete examples of how the current applicant guidebook was developed. more
It highly concerns me when domain registries controlling a certain Top-Level Domain (TLD) raise the wholesale prices they charge to registrars (domain retailers) without consultation to domain registrants (domain buyers). When this happens, all the registrars will need to pay more to the registry for every domain which they register or renew for a customer. They will in turn raise their prices to cover the additional cost to them. Transferring the domains to a different registrar will not help, as all the registrars for that TLD will be forced to raise prices as they all have to pay more to the registry. It is an open secret that the current state of IPv4 allocation contains many accidental historical imbalances and in particular developing countries who wish to use IPv4 are disadvantaged by the lack of addresses available through ordinary allocation and are forced into purchasing addresses on the open market. As most of the addresses for sale are held by organisations based in the developed world, this amounts to a transfer of wealth from the developing world to the developed world, on terms set by the developed world. more
While we are spending years figuring out how to create the perfect generic Top-Level Domain (gTLD) launch and guidebook, the Internet is moving along at an extraordinary pace without any care about ICANN policy-making. You want to decide what results you expect, who you'll target and what messages you want to send them, as well as study your options and understand them clearly. New top-level domain applicants are getting plenty of advice nowadays about how to launch their new Registry. In addition to thinking about their branding and distribution, they should also be thinking about their business practices with Registrars. What many of them do not realize is that their cash flow practices, with respect to Registrars, may be a factor of whether ICANN Registrars even support their Registry. more

The Internet Corporation for Assigned Names and Numbers (ICANN) concluded its Montreal meeting with a landmark agreement that cements the relationship between ICANN and the worldwide community of country-code top-level domain registries. "Today's agreement represents both a historic achievement for the ICANN process, and a powerful vote of confidence in the newly reformed ICANN 2.0," said Paul Twomey, ICANN's president and CEO.
Finalizing four years of dialogue and negotiation, the creation of the Country-Code Names Supporting Organization (ccNSO) heralds a new era of cooperative and productive relations among ICANN and the country-code domain registries. The structure and rules for ICANN's new ccNSO were endorsed by domain registry organizations and individual managers representing every region and populated continent. "Today's agreement is a testament to how ICANN is seen as a forum the international Top Level Domain administrators can come together and jointly address issues," said Twomey. more
Popular Enterprises LLC, the parent company of Netster.com, has filed a $100 million dollar lawsuit against VeriSign, Inc. The Complaint alleges antitrust violations, unfair competition and violations of the Deceptive and Unfair Trade Practices Act based upon VeriSign's release of the Site Finder product. The suit requests injunctive relief to prevent VeriSign from operating Sitefinder, and to otherwise cease what Popular Enterprises believes to be its monopolistic practices. more
