Brand owners unfamiliar with the domain name system (DNS) are hearing that their first step in registering a top level domain (TLD) is to select a back-end TLD registry provider. The fear instilled in them is that if they don't act quickly, all available service providers will have reached their capacity. Given ICANN's tight and inflexible application submission schedule, brands don't want to be left at the starting gate. more

In an attempt to appease the Governmental Advisory Committee, ICANN's New gTLD Program Committee directed ICANN staff to amend the Registry Agreement so that all New gTLD Registries will be required to include a provision in its Registry-Registrar Agreement that requires Registrars to include in their Registration Agreement a provision prohibiting Registered Name Holders from distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law, and providing (consistent with applicable law and any related procedures) consequences for such activities including suspension of the domain name. more

The Council of European National Top-Level Domain Registries (CENTR) announced today their response to Professor Michael Geist's draft survey report "Government and country-code top level Domains: A global survey", which was conducted on behalf of the International Telecommunication Union (ITU) in December 2003. "In the last decade the general trend has been to de-regulate markets in the Communications Industry, which continues to stimulate economic growth and innovation, and it seems perverse that this ITU supported report is seeking to go against the proven successful trend," said Paul Kane, chairman of CENTR. more
Given that it's been a few years since my last domain name year in review, I've really enjoyed looking back at this year's biggest domain name stories and seeing how this industry has evolved. This year, in particular, has seen some notable changes which are likely to impact the domain name landscape for years to come. So without further ado, here is my list for 2017. more
Is the new ".tel" domain launching today more than just a pretty web interface to DNS? Is it something really unique? Is it a new service that couldn't be easily replicated elsewhere? In case you haven't been following the subject, a company called Telnic has launched a new top-level DNS domain ".tel" today. Today, December 3rd, is the launch of the "Sunrise" period where companies can (for a high price) obtain the ".tel" domain associated with their trademark. more
The Domain Name System Security Extensions (DNSSEC) is a suite of IETF-developed specifications designed to validate information provided by the Domain Name System (DNS). ... When the root zone was signed in June 2010, this acted as a catalyst for TLD operators to deploy DNSSEC on their side. We have seen a gradual but significant increase in signed TLDs since then. It highly concerns me when domain registries controlling a certain Top-Level Domain (TLD) raise the wholesale prices they charge to registrars (domain retailers) without consultation to domain registrants (domain buyers). When this happens, all the registrars will need to pay more to the registry for every domain which they register or renew for a customer. They will in turn raise their prices to cover the additional cost to them. Transferring the domains to a different registrar will not help, as all the registrars for that TLD will be forced to raise prices as they all have to pay more to the registry. Applicants for the recently approved launch of new generic top-level domains (gTLDs) should seriously take into account niche markets instead of focusing on the number of registrations. Drawing on failure and success drivers when it comes to Internet start-ups, it becomes clear that the failures of recently introduced generic top-level domains (gTLDs) - such as .biz and .info - are due to their focus on the number of registrations (i.e., scale) instead of focusing on niche markets. On the other hand, start-up successes have been consequences of prudent initial niche strategies. more
Reading through Brian Kreb's blog last week, he has an interesting post up on the White House's call upon the industry on how to formulate a plan to stem the flow of illegal pharmaceuticals...It is unclear to me whether or not the goal of this initiative is to stem the flow of online crime in general or to reduce the flow of illegal pharmaceuticals flowing into the United States (since presumably this cuts into the profits of large pharmaceutical companies... more
Sell a trademark as a keyword for directed search or online auctions and make $billions. But use a trademark in a domain name for direct search and lose the domain, or worse. The gap between how trademark law treats the two species of search has grown wider in the wake of several landmark 2010 trademark law decisions -- and provides another sound reason why ICANN should not establish any new rights protections for new generic Top-Level Domains (gTLDs) beyond those STI-RT compromise positions already included in the fourth version of its Draft Applicant Guidebook (DAGv4). more
Garth Bruen reports on a paper published by the American Society of Law, Medicine & Ethics of Boston University School of Law authored by Bryan A. Liang and Tim Mackey titled, "Searching for Safety: Addressing Search Engine, Website, and Provider Accountability for Illicit Online Drug Sales". From the paper: "Online sales of pharmaceuticals are a rapidly growing phenomenon. Yet despite the dangers of purchasing drugs over the Internet, sales continue to escalate. These dangers include patient harm from fake or tainted drugs, lack of clinical oversight, and financial loss. Patients, and in particular vulnerable groups such as seniors and minorities, purchase drugs online either naïvely or because they lack the ability to access medications from other sources due to price considerations. Unfortunately, high risk online drug sources dominate the Internet, and virtually no accountability exists to ensure safety of purchased products." more
