The Council of European National Top-Level Domain Registries (CENTR) announced today their response to Professor Michael Geist's draft survey report "Government and country-code top level Domains: A global survey", which was conducted on behalf of the International Telecommunication Union (ITU) in December 2003. "In the last decade the general trend has been to de-regulate markets in the Communications Industry, which continues to stimulate economic growth and innovation, and it seems perverse that this ITU supported report is seeking to go against the proven successful trend," said Paul Kane, chairman of CENTR. more

There's a great fight going on right now in Philadelphia...The case is about a Pennsylvania statute [PDF] that mandates that Pennsylvania ISPs remove access to sites that the AG believes contain child pornography. Now, child pornography is abhorrent and any ISP will cooperate in taking down such sites that it is hosting. But the problem is that in complying with the statute with respect to sites the ISPs don't themselves host, ISPs are (rationally) using either IP blocking ("null routing") or "domain poisoning" techniques, both of which (particularly the IP number blocking) result in rendering inaccessible millions of perfectly legal sites. more
In this two-part series article, Andrew McLaughlin takes a critical look at the recently reported study, Public Participation in ICANN, by John Palfrey, Clifford Chen, Sam Hwang, and Noah Eisenkraft at the Berkman Center for Internet & Society at Harvard Law School..."The study's presentation and analysis of data contain much of interest, and much that could assist ICANN (and other policy-making bodies) in improving its use and management of online public forums. But the study's value is diminished by two rather fundamental shortcomings: (1) its misapprehension of both the theory and the practice of ICANN's policy-development process, and (2) the sizeable gap between the broad scope of the study's conclusions and the very narrow -- indeed, myopic -- focus of the analysis from which they are derived. Simply put, the study scrutinizes a small and misleading corner of ICANN (namely, its online public comment forums) and leaps to a sweeping (and, in my view, unwarranted) conclusion." more

In view of the vast size of the global population of Internet users, and the specialized technical focus of ICANN's policy-making responsibilities, it would be a hopeless task to try to achieve truly representative statistical proportionality among ICANN's participants, committees, task forces, or Board members. Rather, here's how the U.S. government's foundational 1998 DNS policy statement described the core principle of 'representation'." more
Two things are important to stress. First, nothing was decided in this meeting, and no actions will be taken until the next meeting in 2005. Secondly, and more importantly, as with anything the devil is in the details. Given the vagueness of the documents available, there are few reliable conclusions that can be drawn from the summit...Before any judgments can be made about the effectiveness, or feasibility of the ideas outlined in the Plan of Action more concrete information is needed. The details of these plans are currently unknown to the Internet community at large, and may even be unknown to the members of the WSIS. Based on the information that is available it appears the Plan of Action needs to be thought through a little more thoroughly. more
I've been following the recent news on the World Summit on the Information Society, and it's getting really bizarre. The Wired article is one example of out of the out-of-this-world coverage on the World Summit; I heard a similar spin yesterday on a radio show that often shares material with the BBC. What king or dictator or bureaucrat has signed the document giving power over the Internet to one organization or another? Did I miss the ceremony? One laughable aspect of news reportage is that the founders and leaders of ICANN always avowed, with the utmost unction, that they were not trying to make policy decisions and were simply tinkering with technical functions on the Internet. more
The World Intellectual Property Organization (WIPO) -- the same organization whose head recently equated intellectual property infringement with terrorism -- has been pressing ICANN to add domain name monopolies on the names of countries, and the names and acronyms of inter-governmental organizations, into the Uniform Domain Name Dispute-Resolution Policy (UDRP). Despite the fact that no-one but WIPO seems to want these new exclusions, a working group has nonetheless been convened to study their recommendations. more

On the one hand they do not trust government bureaucrats to run the Internet, out of a justified fear that regulation through multilateral negotiations might lead to censorship and stifle innovation. On the other hand they criticize the corporate agendas of the engineering class that is anything but representative. What models should activists propose in the light of the World Summit on the Information Society (WSIS)? There seems to be no way back to a nation state 'federalist' solution. Geert Lovink: "Would it make sense to analyse ICANN (and its predecessors) as a test model for some sort of secretive 'world government' that is run by self appointed experts? Could you explain why governments are seen as incapable of running the Internet? This all comes close to a conspiracy theory. I am not at all a fan of such reductionist easy-to-understand explanations. However, the discontent with 'global governance' discourse is widespread and it seems that the International Relations experts have little understanding how the Internet is actually run. Where do you think theorization of Internet governance should start?" more
Attacks on ICANN are coming from several different directions, and the list of concerns includes "cybercrime and protection of intellectual property rights."... First, it's not apparent to me that any government can "control" the internet -- and it's even less likely that that control can happen through the DNS. The most that governments will do will be to build walls between nations, requiring their ISPs to point only to approved sites. (China is well on its way to doing this already.) That's not controlling the Internet, that's creating different, national Internets. more
In the past, most measurements of registrar market share have tracked overall registrar shares -- number of domains registered by a registrar divided by number of domains registered by all registrars. In this article, I propose some alternatives -- particular subsets of domains in which to measure registrar market shares, providing a basis for comparison with overall market shares. Results vary dramatically across these subsets, with implications on the future customer retention rates of the corresponding registrars. more
In a Message from RegistryPro Advisory Board to Tina Dam on 24 October 2003, it is noted that .Pro is, again, asking ICANN to allow for the registration of 2nd level domains. I am, again, of mixed opinion on this. On the one hand, a registry should be able to do what it wants, within reason. This clearly falls into that category. On the other hand, .Pro has been denied once already on the grounds that registering 2nd level domains is not the proposal upon which they were approved in the "testbed" procedure of November 2000. more

"With relation to the Internet and also IP addresses, the "scarcity" is more complicated: there are not only intellectual property issues with regards to domain names, but there is also an issue of managing the integrity of the system. For any naming or numbering system to work, it is essential that the names and addresses used cannot be confused with any other -- in other words, no one system can have two end-points with the same fully qualified number or name..." more
