ICANN Clarifying Questions - How Are They Structured? (Part 1 of 3)

Several weeks ago ICANN issued clarifying questions to approximately 50 of the 1,930 new gTLD applications submitted last spring. Some of our clients were selected for this pilot effort and we've had the opportunity to review seven sets of clarifying questions totaling approximately 30 individual questions. ICANN has indicated that in late November they will begin issuing Clarifying Questions to the balance of applicants. more

Attacking the Multi-Stakeholder Model

"If at first you don't succeed, try and try again." A famous saying, that some within the ICANN world seem to think actually means: "if at first you don't get what you want, try and try again." The basic premise of the ICANN system is simple and fair: get all parties to work together, give everyone an equal voice, and act on whatever consensus emerges. ICANN insiders have coined this the "multi-stakeholder, bottom-up, policy development process". more

ICANN Asked by Demand Media to “Ignore” Complaints from US Republican Party for the .republican gTLD

Kevin Murphy reporting in DomainIncite: "Last month, the Republican National Committee and the Republican State Leadership Committee submitted comments to ICANN arguing that Demand would be an unsuitable custodian for the gTLD [.republican]. Demand is best known for its "unofficial, mediocre and sometimes incorrect" content farms, such as eHow, the letter (pdf) said..." more

NEW CEO, Trademark Clearinghouse, URS and RAA Take Center Stage at ICANN 45 in Toronto

At his first meeting as CEO of ICANN, Fadi Chehade showed up ready to work AND to listen. ICANN's new CEO described his objectives for the organization which included 1) affirmation of purpose, 2) operational excellence, 3) internationalization, and 4) evolution of the multi-stakeholder model on which ICANN is built. He also described significant organizational changes to ICANN leadership and staff... more

Africa at ICANN - Continent on the Move

There was one obvious take-away from this week's ICANN meetings in Toronto, and for once it was less about policy and more about geography. Simply put, Africa is really - finally - coming together at ICANN, with a new energy, new unity and lots of new participation from African participants. And from top to bottom, the ICANN community seems to be taking notice. more

Halftime Is over for the New gTLD Applicants: Musings of a Hungry Marketer

As I sit in Schiphol airport awaiting the final leg of my journey home from ICANN Toronto, I'm thinking of all the work that lies ahead in the coming months. The sense of being caught in the holding pattern that descended over the industry after the Prague meeting and lasted into September, is evidently over. The wheels have thankfully begun to turn again on the path towards the new TLDs finally going live. more

Looking Ahead - UDRP Bad Faith Analysis and New gTLDs

The Internet, at nearly every stage of its evolution, has effected change in existing intellectual property industries as those industries struggle to keep up with the march of technological advancement. For example, the entertainment industry has seen widespread piracy and bootlegging of just and soon-to-be released movies as a result of the increased availability of broadband Internet access in the home, and efficient peer-to-peer file-sharing technologies online. In response the entertainment industry has backed a wave of proposed legislation including the maligned Stop Online Piracy Act (SOPA) and Protect IP Act (PIPA). more

ICANN TMCH: The Haunted Trademark Clearance House

When the fantasy of a universal trademark clearance house was floated in the name of protecting existing trademark owners by the opposing lobbies against the global domain name expansion, particularly the gTLD programs, the domain name industry and ICANN quickly accepted the idea. A universal trademark clearance house is perhaps a greatest idea but in reality a fantasy. Today, at ICANN, the best minds are teamed-up and struggling to get the TMHC (Trademark Clearance House) constructed. more

Emerging Cyber-Security Threats and Implications for the Private Sector

The new gTLD program will have a profound impact on the private sector's increasing dominance over Internet information resources and ownership of critical registry technical infrastructure assets. It is already anticipated that only the private sector will take full advantage of the commercial possibilities... However, the successful introduction of new gTLDs will also create new challenges of security for the private sector. more

The ‘Domain Rights Dozen’ - ICA’s RPM Revision Review Principles

As the fall of 2012 begins the implementation of rights protection mechanisms (RPMs) for new gTLDs is reaching a critical stage... Given the half year interval between the upcoming Toronto ICANN meeting and the following Beijing meeting in April 2013, it is highly desirable, and perhaps essential, that community discussion in Toronto result in a clear consensus on how RPM implementation should proceed if new gTLDs are to launch without further delay and if potential registrants are to perceive them as acceptable platforms for speech and commerce. more

Dot UK, A No-Brainer!

British registry Nominet has launched a consultation on whether .UK should be opened up at the top level under a scheme called direct.uk. Currently, registrations are only allowed at the second level, .CO.UK being Britain's main Internet suffix. The question really isn't should this be done. The question is: why has it taken so long to get here? more

Community Support Required for Alternative Trademark Clearinghouse Solution

It's time for the community to demonstrate its resolve to see ICANN implement a successful and effective Trademark Clearinghouse (TMCH). Let's be clear here. The current ICANN implementation model and approach is flawed and needs attention. Following more than three months of consultation and negotiation, today I'm pleased to be able to present the domain name and trademark protection industries with an alternative solution for the operation of ICANN's Trademark Clearinghouse for the new Top-Level Domain (TLD) program. more

Letter to ICANN on Big Brands Proposed Usage of Generic Domain Extensions

We have been taking an active interest in the development of the new TLD program by ICANN and excited by the many opportunities and challenges that this "opening up" will bring to us, our customers and the internet ecosystem as a whole. However, we also have our concerns about how some entities wish to use generic domain name extensions as "walled gardens". more

Musings on Metering: An Update from ICANN’s Latest Meeting

ICANN held another update for new gTLD applicants last week, revealing that the proposal to meter the introduction of new gTLDs received many suggestions during the open comment period. This was just the first step to what I imagine will be a long process - one that will continue on September 12 when ICANN holds a public consultation that will offer more detailed discussion on the many different options for metering. more
