On Friday, 14 March 2014, the U.S. Department of Commerce National Telecommunications and Information Administration (NTIA) announced its intention to transition the IANA functions to the global multistakeholder community. As expected, the announcement has sent adrenaline coursing through the veins of Internet governance experts and government policy people the world over. I'd argue, however, that it is an important point for the Internet's technical experts to sit up and take notice, as well: the fact that you are probably saying "what problem does this solve?" is a testimony to how much works well today, and we want to make sure it continues to work well in any future arrangements. more
As an industry insider and technologist, it's always tempting when discussing something new, such as the Trademark Clearinghouse (TMCH), to jump into the gritty details to try solving problems. However, in this case, we would be jumping a step ahead because it's fair to say most of the general community is not well informed about the current implementation challenges around the TMCH. more
Trevor Little reporting in the World Trademark Review writes: "The Chinese government has announced that registries and registrars will have to meet a number of conditions and obtain the approval of the Ministry of Industry and Information Technology (MIIT) before being allowed to engage in commercial and operational activities in China." more
In one of the first (if not the first) UDRP cases for .cat, the auto giant BMW appears to have filed a WIPO case over the BMW.cat domain name. Other prospective new TLD operators have tried to suggest in ICANN meetings that these new TLDs do not cause problems with cybersquatting or defensive registrations... Obviously, given the above WIPO case, that statement is false. more

Words (and by extension their constituent letters) are as free to utter and use as is the air sustaining life. No one owns them. There is no toll fee to be paid to dictionary makers who curate them. There are, however, two carve-outs from this public domain, namely words and letters businesses use as designations of origin for their marketplace presence, protected by trademark law; and words and letters arranged expressively by authors, protected by copyright law. more
When I began writing about the dot-org sale, it was out of concern for the loss of what I felt strongly was long understood to be a unique place in the Internet's landscape. Like a national park, dot-org deserved special protection. It turns out lots of people and organizations agreed. On April 30th, 2020, The ICANN Board upheld these values. They unanimously withheld consent for a change of control of the Public Interest Registry to a private equity firm. more
The launch of a new or repurposed Top-Level Domain (TLD) is always surrounded with speculative activity. Some domainers will register domains in the new TLD with hopes of getting rich quick. This week, the ICANN Board will vote on whether to approve the transfer of control of the .ORG domain to a private equity firm called Ethos Capital. This is a weighty decision for ICANN, since in order to approve the sale, it will have to convince itself that this is the right choice in the face of tremendous and widespread opposition, including from those who will be most affected by the sale. more
