For complainant, the second leg in determining cybersquatting under the Uniform Domain Name Dispute Resolution Policy (UDRP) is evidence respondent lacks both rights and legitimate interests in the challenged domain name (Paragraph 4(a)(ii)). I underscore "both" because proving one but not the other is not good enough. This seems obvious, so why suggest there is something to explore about "rights" and "legitimate interests" if their meanings hardly need explication? more

These doors begin with the addresses themselves, which may not include the .com domain. In fact, I'd recommend that most localized websites not use the .com domain, as this is an overloaded domain. During a presentation at the Interop Conference currently ongoing in Los Vegas, Mike Repass, Product Manager at Google, informed the audience that a new cloud storage service will be rolled out by Google within weeks. The role out is part of Google's expansion of its AppEngine platform which is said to offer similar security infrastructure as Gmail and Google Apps. "[T]he app partitioning and isolation are the same best of breed technology approaches that Google is developing for the rest of its customer base," Repass said. more
ICANN has made great strides in implementing steps to improve the organization's transparency, accountability, openness - according to their most recent Status Report [PDF]. The report describes the requirements of their MOU with the Department of Commerce and what the organization has done to toward achieving these goals. When a network is subject to a rapid increase in traffic perhaps combined with a rapid decrease in capacity (for example due to a fire or a natural disaster), there is a risk of congestion collapse. In a congestion collapse, the remaining capacity is so overloaded with access attempts that virtually no traffic gets through. In the case of telephony, everyone attempts to call their family and friends in a disaster area. The long standing telephony approach is to restrict new call attempts upstream of the congested area... This limits the amount of new traffic to that which the network can handle. Thus, if only 30% capacity is available, at least the network handles 30% of the calls, not 3% or zero... more
