This article was originally intended to be a short one focused on indications that ICANN was exploring the establishment of a legal nexus outside the United States and discussing what that might mean - and whether it was consistent with the Affirmation of Commitments (AOC) entered into with the United States in 2009. Then, as completion neared, came the sudden and nearly simultaneous release of the October 7th Montevideo Statement and the announcement two days later of a proposed 2014 Brazil "Summit" focused on restructuring Internet governance. At that point the task vastly expanded. more
There is probably no worldwide community without at least one member located in the US. But does this qualify the closing of a community to only US based members and, by extension, to exclude all other eligible entities from around the world solely because of arbitrary geographical circumstances based upon company whims? more
As the launch of the first of the new gTLDs draws ever closer, more and more applicants are beginning to publicise their business models and ideas for putting the Domain Name System (DNS) to good use. By doing so, they are also shedding light on what promises to be a far less uniform Top Level for the Internet than might have previously been feared. A schism is appearing in the type of applicant/TLD model being enacted. Up until now, Donuts, Google et al have tended to hold the spotlight, and for good reason. more
Something has shifted. I think it might be the end of the holding pattern we as new gTLD applicants/followers/enthusiasts and generally speaking, the entire community, have been caught up in. Hot on the heels of other ICANN Internationalized Domain Name (IDN) Top-Level Domain (TLD) launch errors, we now have another example of ICANN's failure to comprehend the differences between IDN and ASCII names, this time to the detriment of potential IDN registrants and the new IDN generic TLD (gTLD) Registries. This gaff really makes you wonder whether the SSAC and Multilinguism departments at ICANN have ever met. more
The first Sunrise Period for trademark owners under ICANN's new gTLD program has begun. The gTLD is the Arabic IDN '????, or "dot-Shabaka". The term roughly means "web" in Arabic and eligibility for registrations is unrestricted. The Dot-Shabaka Registry has made it clear for months that they wanted to be the first TLD to launch this year. more
It was never obvious at the outset of this grand Internet experiment that the one aspect of the network's infrastructure that would truly prove to be the most fascinating, intriguing, painful, lucrative and just plain confusing, would be the Internet's Domain Name System. After all, it all seemed so simple to start with: network applications rendezvous with their counterparts using protocol-level addresses, but we users prefer to use "natural" identifiers that act as aliases for these addresses. more
Word to the wise: Fadi Chehadé's ICANN isn't going to take criticism lying down! In the past, the organisation has tended to react to criticism with a silence that was probably considered a way to avoid aggravating critics any further, but instead tended to infuriate people that were expecting answers. No longer. Since Chehadé came in as CEO, they get answers! more
Many law firms and Intellectual Property departments in charge of managing brands and domain names for their customers or businesses must have had that same question: "how do I protect a brand online under the ICANN new gTLD program?" The first potential answer that is usually offered up to an enquirer is: "the Trademark Clearinghouse does that". As time goes by, and the rules under which the Trademark Clearinghouse operates are better defined and understood this answer becomes clearly fallacious. more
DotGreen announced on Friday that it has withdrawn its application for .green from ICANN's new gTLD program. We were surprised to hear the news, particularly after all of the effort that DotGreen has put into building a community and a movement around its application. While we at Innovative Auctions agree with Annalisa that the ICANN Last Resort auction would have been a poor choice for the DotGreen Community, we believe that the Applicant Auction is a great tool for single-string applicants who want to see their TLD used for a community purpose. more
Kevin reported on this last night. As you can see from the reactions to his post a lot of people are surprised, shocked and even quite upset that the DotGreen application has been withdrawn. It's not the only application for the string, which is why it was withdrawn, but to many people in the ICANN space it was the applicant everyone associated with the string. The unfortunate reality of the new TLD process is that money speaks more loudly than anything else. more

As we draw closer to the first new gTLD registry launch, many companies are beginning the arduous task of developing their new gTLD registration and blocking strategies. And after speaking with dozens of clients, I can tell you that the planned approaches are ranging from very minimal registration and blocking strategies for one or two core brands, all the way through to registrations of multiple brands in every single new gTLD registry. more
