After wading through the various IANA Notice of Inquiry (NOI) submissions I thought I would take a break and do a secondary review of the recently concluded ICANN regional meeting in San Francisco. In doing this review there were three things that kind of jumped out at me as still missing in action. more

ICANN Accountability Deficits Revealed in Panel Ruling on .AFRICA

In an important test of ICANN's primary accountability mechanism, its Independent Review Process (IRP), the organization has been handed a stinging blow over its mishandling of the bid for the new generic Top-Level Domain (gTLD) .AFRICA. At the crux of the issue are two competing applications for the .AFRICA new gTLD and the decision by ICANN's Board to abdicate its responsibility to ensure that ICANN's evaluation and subsequent rewarding of the domain was carried out fairly, transparently, and in accordance with the organization's Bylaws, Articles of Organization, and established policies. more

Study Suggests New gTLD Cybersquatting, Defensive Registrations Overestimated

According to recent study conducted by Minds + Machines, historical data analysis suggests brand owners do not necessarily register their brands when it comes to new generic Top-Level Domains. From the report: "A survey of the domain registration behavior of Fortune 100 companies reveals that they have not registered many of their trademarks in recently created generic top-level domains (gTLDs). A sample of 1043 brands were registered in less than 30% of the eight new open gTLDs created after 2001. If historical registration data is a guide, brands are unlikely to undertake many defensive domain name registrations in the proposed new gTLDs, and furthermore are unlikely to be the victims of cybersquatting." more

Loopholes and Ambiguities in Contracts that ICANN Oversees

ICANN oversees the creation of many contracts. Its highest paid contractor has historically been the law firm of Jones Day, and of course ICANN has many lawyers on staff. In the past I've identified loopholes in proposed contracts, and those were corrected before they were exploited. However, are there other loopholes sitting in existing contracts waiting to be exploited, or ambiguities with major financial consequences depending on their interpretation? more

Last week, several hundred commercial parties involved in the ICANN ecosystem gathered in Vancouver for their annual Global Domains Division (GDD) meeting. In a letter to Mr. Rod Beckstrom, President, Internet Corporation for Assigned Names and Numbers (ICANN), the Association of National Advertisers (ANA) has expressed major flaws in ICANN's program for introducing new generic Top-Level Domains. A program which ANA warns would allow as many as 1,000 new Top-Level Domains in the first year and the same cap every year thereafter. more
