With the Trademark Clearinghouse (TMCH) expected to begin accepting submissions within the next month or so, many companies are now attempting to identify marks for inclusion. As a reminder, the TMCH is a centralized repository of validated rights which will be used in support of ICANN's New gTLD Program. Submissions to the TMCH enable brand owners to register their trademarks as domain names during so-called Sunrise Periods. more

Almost everyone that has been working in the domain name industry for a while has a story about .TEL. It was introduced in 2005 and went live in 2009 with a flurry of publicity. It was a grand concept aiming to revolutionize the way in which people keep in touch. ICANN oversees the creation of many contracts. Its highest paid contractor has historically been the law firm of Jones Day, and of course ICANN has many lawyers on staff. In the past I've identified loopholes in proposed contracts, and those were corrected before they were exploited. However, are there other loopholes sitting in existing contracts waiting to be exploited, or ambiguities with major financial consequences depending on their interpretation? more
In a letter to Mr. Rod Beckstrom, President, Internet Corporation for Assigned Names and Numbers (ICANN), the Association of National Advertisers (ANA) has expressed major flaws in ICANN's program for introducing new generic Top-Level Domains. A program which ANA warns would allow as many as 1,000 new Top-Level Domains in the first year and the same cap every year thereafter. more

Having consigned to oblivion the unpopular "digital archery" method of determining who goes first in the new gTLD round, ICANN today announced that it was going to evaluate all new gTLD applications concurrently (the "single batch"), and release all results simultaneously. The decision is a victory for clarity and a very good result for new gTLD applicants. more
Though I have been critical of some of ICANN's shortcomings, I remain a strong supporter of ICANN's role as a private sector-led, multi-stakeholder global regulator for the Internet's core addressing systems. I've just arrived in Singapore, where ICANN's board will almost surely vote to launch an unprecedented expansion plan for generic top-level domains (gTLDs). As the new gTLDs start lighting-up over the next two years, we'll look back on this week as the "end of the beginning" since it ended several years of planning for the actual expansion. After the vote the real work begins: evaluating applications, implementing new mechanisms, and contract compliance on a scale far greater than ICANN has ever seen. more
Like many, I've been watching the rollout of the first 150+ new Top-Level Domains (TLD) with interest. Since the delegation of ????. back in October, we've seen all sorts of TLDs launched -- from brands like .monash to generics like .build. There has been intense scrutiny within our industry on the zone file registration numbers of these delegated TLDs to measure whether or not they are successful. To be fair, this is not a surprise. We've been conditioned by past generic TLD launches to focus on registration numbers. more
The time is now to make sure your brand makes it onto the list of new top-level domain names. Brand owners should immediately start re-enforcing your brands by promoting ".Your Brand" as a top-level domain (TLD) extension. You must implement the strategy through a two-stage process: free ride on pre-launch discussions and submit your application request with ICANN during the application period. more
